In general, pers<strong>on</strong>s with disabilities are marginalized and face discriminati<strong>on</strong> <strong>on</strong> account<br />
of their disability. Some groups of pers<strong>on</strong>s with disabilities face multiple or aggravated<br />
discriminati<strong>on</strong> <strong>on</strong> account of their status or membership in a minority group. They experience<br />
discriminati<strong>on</strong> due to their disability as well as other characteristic, situati<strong>on</strong> or circumstance,<br />
such as age, social situati<strong>on</strong> or health status. There are many attributes that may result in<br />
multiple or aggravated discriminati<strong>on</strong>. These include, but are by no means limited to: race,<br />
color, sex, language, religi<strong>on</strong>, political or other opini<strong>on</strong>, nati<strong>on</strong>al, ethnic, indigenous or social<br />
origin, property, birth, age, sexual minority status, poverty or other status. A pers<strong>on</strong> with a<br />
disability who requires intensive support may also experience such aggravated discriminati<strong>on</strong>.<br />
People with disabilities may face discriminati<strong>on</strong> in a variety of life circumstances and situati<strong>on</strong>s.<br />
People with disabilities who are living in a humanitarian crisis, such as natural disaster or<br />
armed c<strong>on</strong>flict, may experience discriminati<strong>on</strong> <strong>on</strong> account of their disability and <strong>on</strong> the basis<br />
of their refugee or displaced status. Health status, for example the situati<strong>on</strong> of a pers<strong>on</strong> with<br />
a disability who is living with HIV/AIDS or other communicable disease, may also result in<br />
discriminati<strong>on</strong>.<br />
These differences and a variety of other characteristics and circumstances should be taken<br />
into account when c<strong>on</strong>sidering how best to ensure the human rights and fundamental<br />
freedoms of all pers<strong>on</strong>s with disabilities.<br />
identifying the Many bases of discriminati<strong>on</strong><br />
In 2000, the Charter of Fundamental Rights of the European Uni<strong>on</strong> was adopted<br />
which includes, am<strong>on</strong>g other human rights provisi<strong>on</strong>s, <strong>on</strong>e of the most far-reaching<br />
n<strong>on</strong>-discriminati<strong>on</strong> provisi<strong>on</strong>s in modern human rights law.<br />
Article 21(1) provides: “Any discriminati<strong>on</strong> based <strong>on</strong> any ground, such as sex,<br />
race, colour, ethnic or social origin, genetic features, language, religi<strong>on</strong> or belief,<br />
political or any other opini<strong>on</strong>, membership of a nati<strong>on</strong>al minority, property, birth,<br />
disability, age or sexual orientati<strong>on</strong> shall be prohibited.” 1<br />
The n<strong>on</strong>-discriminati<strong>on</strong> provisi<strong>on</strong> in the Charter makes clear that discriminati<strong>on</strong> <strong>on</strong><br />
any grounds, including those specifically menti<strong>on</strong>ed in the provisi<strong>on</strong>, as well as<br />
other grounds not menti<strong>on</strong>ed in the provisi<strong>on</strong>, are prohibited.<br />
