Specific Rights in the CRPD<br />

Articles 10-30 address specific rights, such as the right to work, the right to political participati<strong>on</strong>,<br />

and many others . A full list of the articles of the CRPD is included at the end of this chapter . In<br />

most cases, these topical articles corresp<strong>on</strong>d closely to articles found in other human rights<br />

c<strong>on</strong>venti<strong>on</strong>s, except that they explain the particular right in the c<strong>on</strong>text of disability . A few<br />

articles, however, address subjects unique to the CRPD such as:<br />

Article 19: Living independently and being included in the community<br />

Article 20: Pers<strong>on</strong>al mobility<br />

Article 26: Habilitati<strong>on</strong> and Rehabilitati<strong>on</strong><br />

They are areas of human rights in which pers<strong>on</strong>s with disabilities either have specific<br />

requirements that may not apply in other c<strong>on</strong>texts, or in which pers<strong>on</strong>s with disabilities have<br />

traditi<strong>on</strong>ally experienced unique types of discriminati<strong>on</strong> and human rights violati<strong>on</strong>s . While these<br />

articles do not create any new rights, they explain rights in the level of detail required for States<br />

to understand their resp<strong>on</strong>sibilities and in many cases do articulate new specific obligati<strong>on</strong>s or<br />

measures not previously included in internati<strong>on</strong>al law .<br />

REGIoNAl DISAbIlITy RIGhTS CoNvENTIoNS<br />

As of 2007, the <strong>on</strong>ly regi<strong>on</strong>al instituti<strong>on</strong> with a disability-specific c<strong>on</strong>venti<strong>on</strong> is the Inter-<br />

American Commissi<strong>on</strong> <strong>on</strong> Human Rights, which developed the Inter-American C<strong>on</strong>venti<strong>on</strong><br />

<strong>on</strong> the Eliminati<strong>on</strong> of all forms of Discriminati<strong>on</strong> against Pers<strong>on</strong>s with Disabilities in<br />

1999 . However, most regi<strong>on</strong>al instituti<strong>on</strong>s have adopted opti<strong>on</strong>al protocols, treaties that<br />

modify another treaty, to existing c<strong>on</strong>venti<strong>on</strong>s or have developed n<strong>on</strong>-binding resoluti<strong>on</strong>s,<br />

recommendati<strong>on</strong>s, and/or plans that address disability rights . In some cases, pers<strong>on</strong>s with<br />

disabilities are specifically menti<strong>on</strong>ed in the general regi<strong>on</strong>al human rights instruments.<br />

KEy NoN-bINDING INSTRUmENTS oN DISAbIlITy<br />

world Programme of Acti<strong>on</strong> C<strong>on</strong>cerning Disabled Pers<strong>on</strong>s:<br />

The UN declared 1981 as the “Internati<strong>on</strong>al Year of Disabled Pers<strong>on</strong>s” (IYDP) with the theme<br />

of full equality and participati<strong>on</strong> of pers<strong>on</strong>s with disabilities and a call for plans of acti<strong>on</strong> at<br />

the nati<strong>on</strong>al, regi<strong>on</strong>al, and internati<strong>on</strong>al levels . One important outcome of the IYDP was the<br />

development by the UN of the World Programme of Acti<strong>on</strong> C<strong>on</strong>cerning Disabled Pers<strong>on</strong>s with<br />

the stated purpose “to promote effective measures for preventi<strong>on</strong> of disability, rehabilitati<strong>on</strong><br />

and the realizati<strong>on</strong> of the goals of ‘full participati<strong>on</strong>’ of disabled pers<strong>on</strong>s in social life and<br />

development and of equality .” To provide a timeframe for governments to implement the World<br />

Programme of Acti<strong>on</strong>, the UN declared 1983-1992 the United Nati<strong>on</strong>s Decade of Disabled<br />

Pers<strong>on</strong>s .<br />

UN Standard Rules <strong>on</strong> the Equalizati<strong>on</strong> of opportunity for Pers<strong>on</strong>s with Disabilities:<br />

Many people believed that the World Programme of Acti<strong>on</strong>, although valuable, would not<br />

achieve the results needed to ensure that the rights of disabled pers<strong>on</strong>s were respected .<br />
