whO eXPeRienCe MUltiPle DisCRiMinAtiOn?<br />

The principle of n<strong>on</strong>-discriminati<strong>on</strong> is <strong>on</strong>e of the most fundamental norms in human rights law.<br />

The rights of pers<strong>on</strong>s who face discriminati<strong>on</strong> <strong>on</strong> account of their particular status are well<br />

recognized in human rights treaties. Indeed, the cornerst<strong>on</strong>e of human rights protecti<strong>on</strong> as set<br />

forth in the Un charter is its n<strong>on</strong>-discriminati<strong>on</strong> provisi<strong>on</strong>, which provides that the UN shall<br />

promote “universal respect for, and observance of, human rights and fundamental freedoms<br />

for all without distincti<strong>on</strong> as to race, sex, language, or religi<strong>on</strong>.” 2 All major internati<strong>on</strong>al human<br />

rights c<strong>on</strong>venti<strong>on</strong>s c<strong>on</strong>tain n<strong>on</strong>-discriminati<strong>on</strong> provisi<strong>on</strong>s and build up<strong>on</strong> the principle of n<strong>on</strong>discriminati<strong>on</strong><br />

found in the UN Charter.<br />

The Universal declarati<strong>on</strong> of human Rights (UDHR) provides that:<br />

Every<strong>on</strong>e is entitled to all the rights and freedoms set forth in [the UDHR]<br />

without distincti<strong>on</strong> of any kind, such as race, colour, sex, language, religi<strong>on</strong>,<br />

political or other opini<strong>on</strong>, nati<strong>on</strong>al or social origin, property, birth or other<br />

status. 3<br />

The internati<strong>on</strong>al covenant <strong>on</strong> civil and Political Rights (ICCPR) 4 c<strong>on</strong>tains a n<strong>on</strong>discriminati<strong>on</strong><br />

clause mirroring that found in the UDHR, an equal rights provisi<strong>on</strong> between men<br />

and women, as well as a provisi<strong>on</strong> guaranteeing to pers<strong>on</strong>s bel<strong>on</strong>ging to ethnic, religious or<br />

linguistic minorities the rights, in community with other members of their group, to enjoy their<br />

own culture, to profess and practice their own religi<strong>on</strong>, and to use their own language.<br />

Specialized human rights c<strong>on</strong>venti<strong>on</strong>s have been drafted in order to address in more detail<br />

the rights of populati<strong>on</strong>s who may face additi<strong>on</strong>al barriers to the enjoyment of their rights<br />

<strong>on</strong> account of their membership in a minority or particularly disadvantaged group. These<br />

include, for example, the c<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the eliminati<strong>on</strong> of All forms of discriminati<strong>on</strong><br />

against women (cedAw), 5 the c<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the eliminati<strong>on</strong> of All forms of Racial<br />

discriminati<strong>on</strong> (ceRd), 6 the c<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Rights of the child (cRc), 7 and the<br />

c<strong>on</strong>venti<strong>on</strong> <strong>on</strong> the Rights of Migrant workers. 8 The rights of indigenous people are<br />

addressed in c<strong>on</strong>venti<strong>on</strong> c<strong>on</strong>cerning indigenous and Tribal Peoples in independent<br />

countries (ilo no. 169) 9 , as well as the declarati<strong>on</strong> <strong>on</strong> Rights of indigenous Peoples 10<br />

adopted by the UN General Assembly in September 2007. Other populati<strong>on</strong> groups are<br />

similarly pressing for greater recogniti<strong>on</strong> of their human rights through the adopti<strong>on</strong> of<br />

specialized c<strong>on</strong>venti<strong>on</strong>s or n<strong>on</strong>-binding instruments, including, for example, older pers<strong>on</strong>s.<br />
