CHAPTER 100 - COMMENCEMENT OF ACTION AND PROCESS<br />

AMEND Rule 3-102 to clarify section (a) <strong>and</strong> to add a certain<br />

cross reference, as follows:<br />

Rule 3-102. TRIAL DATE AND TIME<br />

(a) Fixed by Clerk<br />

At the time the complaint is filed, the Upon the filing of<br />

the complaint, the clerk shall fix the date <strong>and</strong> time for trial of<br />

the action. which shall be not less than 60 days after the date<br />

of filing, When the notice of intention to defend is due within<br />

15 days after service, the original trial date shall be not less<br />

than 60 days after the complaint was filed. or not less than 90<br />

days after filing when service of process is to be made out of<br />

State or upon a statutory agent for a nonresident. When the<br />

notice of intention to defend is due within 60 days after<br />

service, the original trial date shall be not less than 90 days<br />

after the complaint was filed. With leave of court, an action<br />

may be tried at an earlier sooner than on the date than that<br />

originally fixed.<br />

(b) Reassignment<br />

Subject to section (c) of this Rule, when service of<br />
