TITLE 4 - CRIMINAL CAUSES<br />

CHAPTER 200 - PRETRIAL PROCEDURES<br />

AMEND Rule 4-216 to delete current section (a); to change<br />

the tagline of new section (a); to add new language to section<br />

(a) pertaining to a judicial officer determining probable cause<br />

for a warrantless arrest; to require the release of a defendant<br />

on personal recognizance with no other conditions of release if<br />

there was no probable cause for a warrantless arrest; to add<br />

certain statutory references to section (b); to add language in<br />

section (b) clarifying that a judicial officer who releases a<br />

defendant in accordance with that section on personal<br />

recognizance or on bail may impose conditions in either case; to<br />

eliminate a certain cross reference; to conform certain language<br />

in sections (c), (d), <strong>and</strong> (e) to language in section (b); to<br />

require the judicial officer under certain circumstances to take<br />

into account certain information to the extent available; to<br />

require the judicial officer to state in writing or on the record<br />

the amount <strong>and</strong> terms of any bail; to exp<strong>and</strong> on the bail bond<br />

provisions of subsection (e)(4); to conform statutory references<br />

to recent legislation; to add clarifying language to section (h)<br />

concerning the power of a judge to alter conditions set by<br />

another judge or by a commissioner; to add cross references to<br />

Rules 1-361 <strong>and</strong> 4-347 following section (j); <strong>and</strong> to make certain<br />

stylistic changes, as follows:<br />
