In Category Eleven are a proposed amendment to Rule 10-301<br />

(d) that allows a certificate of the Administrator of the United<br />

States Department of Veterans Affairs stating that a person has<br />

been rated by the Department as disabled to be substituted for<br />

the physician’s or psychologist’s certificates otherwise required<br />

by the Rule <strong>and</strong> a conforming stylistic amendment to Rule 10-202.<br />

Category Twelve contains proposed amendments to Rules 16-<br />

723, 16-751, 16-760, 16-761, 16-771, 16-773, 16-775, <strong>and</strong> 16-781.<br />

The amendments clarify that all records of an investigation by<br />

Bar Counsel, including the existence <strong>and</strong> content of any<br />

complaint, are confidential; add certain notice provisions; <strong>and</strong><br />

allow Bar Counsel to file a Petition for Disciplinary or Remedial<br />

Action without prior approval of the Attorney Grievance<br />

Commission when an attorney has been disciplined or placed on<br />

inactive status in another jurisdiction or convicted of a serious<br />

crime.<br />

Category Thirteen comprises new Rules 16-821, 16-822, 16-<br />

823, <strong>and</strong> 16-824. The proposed new Rules contain certain<br />

proscriptions <strong>and</strong> provide procedural details that apply to the<br />

performance of marriage ceremonies by judges. The Rules are<br />

based on the recommendations of the Conference of Circuit Judges.<br />

In Category Fourteen are proposed amendments to two<br />

additional Rules in Title 16. Amendments to Rule 16-101,<br />

proposed at the request of the Conference of Circuit Judges, (1)<br />

provide for the recommendation of the Circuit Administrative<br />

Judge in the appointment process of county administrative judges,<br />

(2) clarify the supervisory role of the Circuit Administrative<br />

Judge, <strong>and</strong> (3) restate the provision relating to the appointment<br />

<strong>and</strong> discharge of court personnel in the event a majority of a<br />

bench is not attained in such matters. An amendment to Rule 16-<br />

406, proposed at the request of the Commission on Judicial<br />

Disabilities, permits the Commission or its designee access to<br />

videotape recordings of circuit court proceedings.<br />

Category Fifteen consists of proposed new Rule 17-105.1 <strong>and</strong><br />

proposed amendments to Rules 17-104, 17-105, 17-107, 17-108, 17-<br />

109, <strong>and</strong> 16-108. Amendments to Rule 17-104 broaden the scope of<br />

the continuing mediation-related requirements in the Rule <strong>and</strong> add<br />

new requirements for mediators in actions assigned to the<br />

Business <strong>and</strong> Technology Case Management Program. New Rule 17-<br />

105.1 defines “neutral expert” <strong>and</strong> addresses the selection of <strong>and</strong><br />

confidentiality requirements applicable to a neutral expert in an<br />

alternative dispute resolution proceeding. A new section in Rule<br />

17-107, together with a related amendment to Rule 16-108,<br />

establish a procedure for the approval of persons seeking<br />

designation to conduct alternative dispute resolution proceedings<br />

in actions assigned to the Business <strong>and</strong> Technology Case<br />
