TITLE 6 - SETTLEMENT OF DECEDENTS’ ESTATES<br />

CHAPTER 400 - ADMINISTRATION OF ESTATES<br />

AMEND Rule 6-455 to change part (c) of the Form of<br />

Election in section (b) <strong>and</strong> to add a new part (d) in the Form of<br />

Election to conform to changes to Code, Estates <strong>and</strong> Trusts<br />

Article, §5-702, as follows:<br />

Rule 6-455. MODIFIED ADMINISTRATION<br />

(a) Generally<br />

When authorized by law, an election for modified<br />

administration may be filed by a personal representative within<br />

three (3) months after the appointment of the personal<br />

representative.<br />

(b) Form of Election<br />

An election for modified administration shall be in the<br />

following form:<br />

BEFORE THE REGISTER OF WILLS FOR _____________________, MARYLAND<br />

ESTATE OF ________________________________ Estate No. ______<br />

ELECTION OF PERSONAL REPRESENTATIVE FOR<br />

MODIFIED ADMINISTRATION<br />

1. I elect Modified Administration. This estate qualifies<br />

for Modified Administration for the following reasons:<br />

(a) The decedent died on ______________ [ ] with a will or<br />
