REPORTER’S NOTE<br />

Amendments are proposed to two Form Interrogatories set forth<br />

in Form No. 5, Domestic Relations Interrogatories.<br />

The proposed amendment to St<strong>and</strong>ard Domestic Interrogatory No.<br />

12 corrects an obsolete reference to Rule 9-203 f. The<br />

requirement that a financial statement be filed under certain<br />

circumstances currently is set forth in sections (e) <strong>and</strong> (f) of<br />

Rule 9-202.<br />

St<strong>and</strong>ard Domestic Relations Interrogatory No. 15 is proposed<br />

to be amended in light of Chapter 419, Acts of 2003 (HB 346),<br />

which adds cruelty of treatment toward a minor child of the<br />

complaining party <strong>and</strong> excessively vicious treatment toward a minor<br />

child of the complaining party to the grounds for absolute divorce<br />

set forth in Code, Family Law Article, §7-103, conforming that<br />

Code provision to comparable grounds for a limited divorce set<br />

forth in Code, Family Law Article, §7-102 (a). Also, Franklin B.<br />

Olmstead, Esq., has pointed out that the language “extreme<br />

cruelty” in the Interrogatory does not track the statutory<br />

language, “cruelty of treatment,” set forth in Code, Family Law<br />

Article, §§ 7-102 (a)(1) <strong>and</strong> 7-103 (a)(7). The Committee<br />

recommends that the Interrogatory be revised <strong>and</strong> restyled so that<br />

the information sought is keyed to a contention of entitlement to<br />

a divorce.<br />
