CHAPTER 600 - JUDGMENT<br />

AMEND Rule 2-645 to delete the word “contingent” from<br />

section (a), as follows:<br />

Rule 2-645. GARNISHMENT OF PROPERTY - GENERALLY<br />

(a) Availability<br />

This Rule governs garnishment of any property of the<br />

judgment debtor, other than wages subject to Rule 2-646 <strong>and</strong> a<br />

partnership interest subject to a charging order, in the h<strong>and</strong>s of<br />

a third person for the purpose of satisfying a money judgment.<br />

Property includes any debt owed to the judgment debtor, whether<br />

immediately payable, or unmatured, or contingent.<br />

REPORTER’S NOTE<br />

The proposed amendments to Rules 2-645 <strong>and</strong> 3-645 delete the<br />

word “contingent” from section (a) of each Rule <strong>and</strong> conform the<br />

Rules to the Court’s holding in Consolidated Construction v.<br />

Simpson, 372 Md. 434 (2002), that contingent debts are not<br />

attachable.<br />
