REPORTER’S NOTE<br />

Concerning the proposed amendment to section (c) of Rule 3-<br />

326, see the Reporter’s note to the proposed amendment to Rule<br />

2-327.<br />

Chapter 275 (HB 97), Acts of 2003 provides that an action<br />

for damages for a dishonored check may be filed in the District<br />

Court regardless of the amount in controversy, <strong>and</strong> if the action<br />

for damages exceeds $25,000, the defendant is allowed to transfer<br />

the action to an appropriate circuit court by filing a timely<br />

dem<strong>and</strong> as prescribed by the Maryl<strong>and</strong> Rules. Accordingly, a<br />

change to Rule 3-326 is being proposed that would include a new<br />

section (d) providing for a procedure to transfer an action for<br />

damages exceeding $25,000 for a dishonored check to the circuit<br />

court. Also, a change to Rule 2-326 is being proposed so that<br />

the procedures for transferring a case to the circuit court on<br />

dem<strong>and</strong> for a jury trial apply to transfer of a dishonored check<br />

action to the circuit court.<br />
