REPORTER’S NOTE<br />

The Rules Committee recommends the addition of language to<br />

section (a) of Rule 2-419 to state that a deposition transcript<br />

<strong>and</strong> any correction sheets attached to it may be used to impeach<br />

or contradict the deponent’s testimony. As amended, the Rule<br />

allows not only the corrected deposition but also the original<br />

deposition to be used for these purposes. For example, if in the<br />

original deposition the deponent states a certain fact <strong>and</strong> then<br />

files a correction sheet that states the opposite of that fact,<br />

both versions of the deponent’s testimony may be used for the<br />

purposes set forth in section (a).<br />

The proposed amendment to section (d) of Rule 2-419 conforms<br />

the Rule to proposed changes to Rules 2-412 <strong>and</strong> 2-415.<br />
