CHAPTER 400 - DISCOVERY<br />

AMEND Rule 2-412 to add a new section (e) concerning<br />

depositions of treating physicians, to redesignate former<br />

section (e) as section (f), <strong>and</strong> to make certain stylistic<br />

changes, as follows:<br />

Rule 2-412. DEPOSITION--NOTICE<br />

(e) Treating Physician<br />

A party serving a notice to take the deposition of a<br />

treating physician shall confer with opposing counsel <strong>and</strong> in the<br />

notice advise the physician of the total number of hours that<br />

will be required for the deposition, including travel time. The<br />

treating physician (1) may not charge a fee for attending the<br />

deposition that is higher than the hourly fee customarily charged<br />

by the physician for in-office patient consultation, (2) may not<br />

charge for any hours exceeding the time estimate set forth in the<br />

notice if the deposition is completed within the estimate, <strong>and</strong><br />

(3) may terminate the deposition when the estimated time has<br />

elapsed.<br />
