the court shall determine by order as soon as practicable after<br />

commencement of the action whether it is to be maintained as a<br />

class action. A hearing shall be granted if requested by any<br />

party. The order shall include the court's findings <strong>and</strong> reasons<br />

for certifying or refusing to certify the action as a class<br />

action. The order may be conditional <strong>and</strong> may be altered or<br />

amended before the decision on the merits.<br />

(d) Partial Class Actions; Subclasses<br />

When appropriate, an action may be brought or maintained<br />

as a class action with respect to particular issues, or a class<br />

may be divided into subclasses <strong>and</strong> each subclass treated as a<br />

class.<br />

(e) Notice<br />

In any class action, the court may require notice pursuant<br />

to subsection (f)(2). In a class action maintained under<br />

subsection (b)(3), notice shall be given to members of the class<br />

in the manner the court directs. The notice shall advise that<br />

(1) the court will exclude from the class any member who so<br />

requests by a specified date, (2) the judgment, whether favorable<br />

or not, will include all members who do not request exclusion,<br />

<strong>and</strong> (3) any member who does not request exclusion <strong>and</strong> who desires<br />

to enter an appearance through counsel may do so.<br />

(f) Orders in Conduct of Actions<br />

In the conduct of actions to which this Rule applies, the<br />

court may enter appropriate orders: (1) determining the course of<br />

proceedings or prescribing measures to prevent undue repetition<br />
