Students from coastal Andhra, on the other hand complain that they are<br />

considered as non-locals for admission to institutions located in the capital <strong>of</strong><br />

their own state.<br />

As explained earlier, admission to various educational institutions in Andhra<br />

Pradesh is governed by the Presidential Order and subsequent legislation flowing<br />

from therein. It is at present beyond the scope <strong>of</strong> this Committee to evaluate the<br />

fairness <strong>of</strong> these systems and suggest alternatives. However, the claim <strong>of</strong> fake<br />

certificates can be looked into by the State Government and the Right to<br />

Information Act can be used by complainants to get justice.<br />

3.7.12 The information provided to the Committee by the Commissioner <strong>of</strong><br />

Collegiate Education A.P. and the Department <strong>of</strong> Technical Education A.P. shows<br />

that at least 85% (and in a large number <strong>of</strong> cases 90% and even 98%) students<br />

in various pr<strong>of</strong>essional colleges are local (Appendix 3.18).<br />

3.7.13 It was brought to the notice <strong>of</strong> the Committee that in case <strong>of</strong><br />

admission to private engineering colleges G.O. MS. 184, Education Department<br />

dated 20/08/1993 and G.O. MS. No 227, dated 22/7/1994 stipulated that all the<br />

seats in the private engineering colleges in the state be pooled subject wise and<br />

distributed among the regions in the ratio <strong>of</strong> 42%, 36% and 22%. As a<br />

result, the students in Telangana had access to only 36% seats in the private<br />

colleges located in Telangana region instead <strong>of</strong> 85% under the Presidential<br />

Order. It is true that they could lay claim to 36% seats in private engineering<br />

colleges situated in coastal Andhra and Rayalaseema but very few <strong>of</strong> them,<br />

it is contended, could afford to go to study there. The matter has already<br />

been decided by Justice B. Subhashan Reddy and Justice T. Ranga Rao (J.<br />

Sameerana v. A.P. State Council for Higher Education and Others) who held<br />

that “the provisions <strong>of</strong> Andhra Pradesh Educational Institutions (Regulations<br />

<strong>of</strong> Admissions) Order, 1974, are applicable to all the private Engineering<br />

Colleges in the state <strong>of</strong> Andhra Pradesh including the minority institutions;<br />

and that admissions shall be made only in accordance with Para 5(1)<br />

<strong>of</strong> the above Order in reserving 85% <strong>of</strong> the available seats in the<br />

respective local areas mentioned in Para 3 and for the local candidates<br />
