5.29 Status <strong>of</strong> implementation <strong>of</strong> the Presidential Order and G.O.<br />

Ms. No. 610<br />

5.29.01 When the Commission compared the 2001 Census figures with the<br />

provisional figures <strong>of</strong> locals/non-locals, it found that the percentage <strong>of</strong> non-locals<br />

in zones V and VI was negligible and far below the limit <strong>of</strong> 20%. The problem,<br />

the Commission concluded, was not at the aggregate level but at the<br />

disaggregated level. It found that, at the disaggregated level, most non-locals<br />

had entered in the category <strong>of</strong> teachers (School Education Department) and<br />

paramedics <strong>of</strong> the Health Department. If we look at the department-wise details<br />

<strong>of</strong> employees identified for repatriation (18,856), this preliminary conclusion by<br />

the OMC is confirmed. Of these, it is understood that 14,784 employees now<br />

stand repatriated.<br />

5.29.02 The maximum number <strong>of</strong> non-locals identified for repatriation was<br />

from School Education (9693) and Health (1168). As such, Para 5(1) <strong>of</strong> G.O. Ms.<br />

No. 610 has been largely implemented, subject to the definition <strong>of</strong> “local<br />

candidate” as given in Para 7 <strong>of</strong> the Presidential Order. Further, it is apparent<br />

that, the Government, through various G.O.s issued over a span <strong>of</strong> four years,<br />

has addressed at least 16 genres <strong>of</strong> deviations directly out <strong>of</strong> the 18 stated in the<br />

report <strong>of</strong> the One Man Commission. However, it must be noted that in 26 years<br />

period when there was non-implementation <strong>of</strong> the Presidential Order G.O. Ms.<br />

No.610, the matter was never vigorously challenged in the Courts <strong>of</strong> Law.<br />

5.30 The Issue <strong>of</strong> Exclusion <strong>of</strong> Certain Posts from the<br />

Presidential Order: The Supreme Court Order <strong>of</strong> 2009<br />

5.30.01 Para 14 <strong>of</strong> the Presidential Order exempts certain classes <strong>of</strong> posts<br />

from the operation <strong>of</strong> the Presidential Order. It means that in respect <strong>of</strong> these<br />

posts there cannot be reservation for locals in any local area. Since most <strong>of</strong> these<br />

posts are situated in Hyderabad, a feeling has taken root that the locals <strong>of</strong><br />

Hyderabad are not being given the benefit <strong>of</strong> reservation. Although Para 14<br />

exempts six classes <strong>of</strong> posts [14(a) to 14(f)], the issue <strong>of</strong> exemption under 14(f)<br />
