Discrimination Complaint Procedure xxxxxxx<br />

Where to File a Complaint<br />

The District encourages its employees and students to contact the Director of Human Resources/EEO Officer prior to<br />

filing a formal complaint or to obtain assistance in determining whether or not an individual has been or is a victim<br />

of discrimination or sexual harassment.<br />

Communicating that Conduct is Unwelcome<br />

The District further encourages students and staff to let the offending person know immediately and firmly that the<br />

conduct or behavior is unwelcome, offensive, in poor taste and/or inappropriate.<br />

Reporting Charges of Harassment<br />

Individuals, who believe they have been subjected to harassment, including discrimination and sexual harassment,<br />

may report charges of harassment by contacting either of the following:<br />

• District Director of Human Resources/EEO Officer, Office of Human Resources, <strong>Feather</strong> <strong>River</strong> Community <strong>College</strong>,<br />

Informal Complaint Procedure<br />

An employee or student who believes he or she has been or is being harassed should inform the District, its agents,<br />

or supervisors of the aggrievement. To accommodate the unique nature of harassment complaints, a pre-grievance<br />

process is provided for the primary purpose of resolution of a complaint at the earliest possible date.<br />

The District’s Director of Human Resources/Equal Employment Opportunity Officer will be available to receive<br />

harassment complaints. Functions of the Director of Human Resources/EEO Officer or complaint advisors include but<br />

are not limited to:<br />

• Counsel the employee and outline the options available<br />

• Obtain a factual written statement of the complaint<br />

• Assist in follow-up investigation<br />

• Interview accused, witnesses and supervisors as appropriate<br />

• Recommend disposition of the complaint<br />

The Director of Human Resources/Equal Employment Opportunity Officer reviews factual information collected to<br />

determine whether the alleged conduct constitutes harassment, giving consideration to the record as a whole and<br />

the totality of circumstances, including the nature of the verbal, physical, visual or sexual favor aspect of the advance<br />

and the context in which the alleged incidents occurred takes and/or authorizes appropriate action.<br />

Efforts will be made to protect the privacy of parties involved in a complaint. Files pertaining to complaints handled<br />

under the pre-formal complaint process will not be made available to the general public.<br />

If, as a result of investigation, a determination is made that such prohibited harassment or discriminatory treatment has<br />

occurred, the superintendent/president may issue a cease and desist order or, if necessary, institute disciplinary action.<br />

If an informal resolution cannot be reached and/or the complainant wishes to file a formal complaint, a complainant<br />

who is a student or employee may then utilize the District’s formal complain procedure. Efforts at informal resolution<br />

may continue after the filing of a formal complaint.<br />

Formal Resolution Procedure<br />

A formal complaint of harassment or discriminatory treatment may be filed by one who alleges that he or she has<br />

personally suffered harassment or by one who has learned of such harassment in his or her official capacity as a<br />

faculty member or administrator. Anonymous complaints will not be accepted.<br />

The complaint shall be in a form prescribed by the Chancellor of the California Community <strong>College</strong>s. Complaint<br />

forms may be obtained from the <strong>Feather</strong> <strong>River</strong> Community <strong>College</strong> District Office of Human Resources, as specified<br />

in the above section of these procedures. Complaint forms may also be obtained online from the Chancellor of the<br />

California Community <strong>College</strong>s at www.cccco.edu/divisions/legal/Discrimination/discrimination.htm.<br />
