8. Local Shops and Establishments Legislations<br />
Under the provisions of local shops and establishments legislations applicable in the states in which establishments<br />
are set up, establishments are required to be registered. Such legislations regulate the working and employment<br />
conditions of the workers employed in shops and establishments including commercial establishments and provide for<br />
fixation of working hours, rest intervals, overtime, holidays, leave, termination of service, maintenance of shops and<br />
establishments and other rights and obligations of the employers and employees.<br />
9. Minimum Wages Act, 1948<br />
The Minimum Wages Act, 1948 (“MWA”) came into force with an objective to prevent exploitation of labour and to<br />
provide for fixation of a minimum wage payable by the employer to the employee. Under the MWA, every employer<br />
is mandated to pay the minimum wages to all employees engaged to do any work skilled, unskilled, and manual or<br />
clerical (including out-workers) in any employment listed in the schedule to the MWA, in respect of which minimum<br />
rates of wages have been fixed or revised under the MWA. Construction of Buildings, Roads, and Runways are<br />
scheduled employments. It prescribes penalties for non-compliance by employers for payment of the wages thus<br />
fixed.<br />
10. Workmen‟s Compensation Act, 1923<br />
The Workmen‟s Compensation Act, 1923 (“WCA”) has been enacted with the objective to provide for the payment of<br />
compensation to workmen by employers for injuries by accident arising out of and in the course of employment, and<br />
for occupational diseases resulting in death or disablement. The WCA makes every employer liable to pay<br />
compensation in accordance with the WCA if a personal injury/disablement/ loss of life is caused to a workman<br />
(including those employed through a contractor) by accident arising out of and in the course of his employment. In<br />
case the employer fails to pay compensation due under the WCA within one month from the date it falls due, the<br />
commissioner appointed under the WCA may direct the employer to pay the compensation amount along with interest<br />
and may also impose a penalty.<br />
11. Maternity Benefit Act 1951<br />
The Maternity Benefit Act, 1951 provides for leave and some other benefits to women employees in case of<br />
confinement or miscarriage etc.<br />
12. Equal Remuneration Act 1979<br />
The Equal Remuneration Act 1979 provides for payment of equal remuneration to men and women workers and for<br />
prevention of discrimination, on the ground of sex, against Female employees in the matters of employment and for<br />
matters connected therewith.<br />
13. Industrial Disputes Act 1947<br />
The Industrial Disputes Act 1947 lays down the machinery and procedure for investigation, settlement and resolution<br />
of Industrial disputes, in what situations a strike or lock-out becomes illegal and what are the requirements for laying<br />
off or retrenching the employees or closing down the establishment.<br />
14. Child Labour Prohibition & Regulation Act 1986<br />
The Child Labour Prohibition & Regulation Act 1986 prohibits employment of children below 14 years of age in<br />
certain occupations and processes and provides for regulation of employment of children in all other occupations and<br />
processes.Employment of Child Labour is prohibited in Building and Construction Industry.<br />
15. The Inter-State Migrant workmen‟s (Regulation of Employment & Conditions of service) Act 1979<br />
The Inter-State Migrant workmen‟s (Regulation of Employment & Conditions of Service) Act 1979 is applicable to<br />
an establishment which employs 5 or more interstate migrant workmen through an intermediary (who has recruited<br />
