SECTION 3.19 Retirement procedure POLICIES & PROCEDURES i. ii. The normal retirement date for a member of the College’s non-academic staff is the end of the month in which his or her 65th birthday occurs. Not less than 6 months nor more than 12 months before a member of staff’s 65th birthday the HR Officer will give written notice to the employee of his or her approaching retirement date. The notice will include reference to the member of staff’s right to request not to retire on that date, and the manner in which such a request should be made and how it will be considered. Retirement procedure iii. A request to continue working past the normal retirement date must: • Be made, in writing if possible, to the Head of Department or Supervising College Officer. • Be made more than three months but less than six months before the notified retirement date. • Must specify whether the employee wishes the employment to continue indefinitely, for a stated period, or until a stated date. • Must expressly state that it is a request under paragraph 5 of the Employment Equality (Age) Regulations 2006. iv. A meeting will be held to consider any request to continue working beyond the normal retirement date: • Within a reasonable period. • Comprising the Head of Department or Supervising College Officer, the HR Officer and the employee. • The employee has the right to be accompanied by another member of the non-academic staff of the College, if he or she so wishes. • The meeting will give full consideration to the representations made by the employee. 112 S TAFF HANDBOOK
Retirement procedure continued... SECTION 3.19 • The College’s decision on the request to continue working will normally be given to the employee within 5 working days and confirmed in writing. POLICIES & PROCEDURES • The employee will be informed of his or her right to appeal against the decision. v. If the employee wishes to appeal: The appeal must be made, in writing if possible, to the Bursar within 7 working days of receipt of the decision. • An appeal meeting will be held within a reasonable time. Retirement procedure • The appeal will normally be heard by the Bursar or such other person as he or she considers appropriate. • The employee will be invited to attend the appeal meeting to state his or her case. • The employee has the right to be accompanied by another member of the non-academic staff of the College, if he or she so wishes. • The College’s decision on the appeal will normally be given to the employee within 5 working days and confirmed in writing. • The appeal decision will be final and binding.
