A NEW ORDINANCE SECTION 16-19 OF THE CODE OF ORDINANCESOF THE TOWN OF KERNERSVILLE REQUIRING THATNEW SIDEWALK CONSTRUCTION BE IN A PROPER WORKMANLIKECONDITION PRIOR TO ISSUANCE OF A CERTIFICATE OF OCCUPANCYWHEREAS, the Board <strong>of</strong> Aldermen and/or the Ordinances, Rules, andRegulations <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong> periodically require that sidewalks be placedupon property being developed with residential and commercial structures; andWHEREAS, it appears to the Board <strong>of</strong> Aldermen that <strong>of</strong>ten times, prior to theissuance <strong>of</strong> a Certificate <strong>of</strong> Occupancy for the newly constructed residential/commercialstructure, there has been damage done to adjacent sidewalks during the course <strong>of</strong>construction; andWHEREAS, it is only reasonable that the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong> should accept, forfuture maintenance, only those sidewalks which are properly installed in a goodworkmanlike manner; andWHEREAS, it is in the best interest <strong>of</strong> the health, safety, and welfare <strong>of</strong> thecitizens <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong> that all sidewalks be and remain in a propercondition;NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE BOARD OFALDERMEN OF THE TOWN OF KERNERSVILLE that the <strong>Town</strong> Code <strong>of</strong> Ordinancesbe and are hereby amended to provide:“Section 16-19 Proper Condition <strong>of</strong> Sidewalks.(a) Every person or entity who/which constructs any newresidential/commercial structure within the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong>,pursuant to requirement(s) <strong>of</strong> the Board <strong>of</strong> Aldermen, Ordinance(s), the<strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong> Public Works Department DevelopmentGuidelines for <strong>Design</strong> and <strong>Construction</strong> and is required to install asidewalk adjacent thereto, shall do so in a proper workmanlike manneraccording to such requirement(s) <strong>of</strong> the Board <strong>of</strong> Aldermen,Ordinance(s), and/or the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong> Public WorksDepartment Development Guidelines for <strong>Design</strong> and <strong>Construction</strong>;(b)The Head <strong>of</strong> the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong> Inspection Division or his/herdesignee shall inspect each sidewalk adjacent to such new residential/commercial structure where a sidewalk is a requirement <strong>of</strong> the Board
