10. In the event the Applicant does not make the required repairs in the timestipulated, or does not maintain the area prior to repairs in an acceptablemanner, then <strong>Town</strong> personnel will maintain and/or repair such cuts andinvoice the Applicant for actual costs plus 50%.11. Applicant will provide during construction and any subsequent maintenanceproper signs, signal lights, flagmen and other warning devices for theprotection <strong>of</strong> traffic in conformance with the latest Manual on Uniform TrafficControl Devices for Streets and Highways and Amendments orSupplements thereto.12. If at any time the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong> shall require the removal <strong>of</strong> orchanges in the location <strong>of</strong> the said facilities, that the Applicant binds himself,his successors and assigns, to promptly remove or alter the said facilities, inorder to conform to the said requirement, without any cost to the <strong>Town</strong> <strong>of</strong><strong>Kernersville</strong>.13. The Applicant will exercise every reasonable precaution during constructionand maintenance to prevent eroding <strong>of</strong> soil; silting or pollution <strong>of</strong> rivers,streams, lakes, reservoirs, other water impoundments, ground surfaces orother property; or pollution <strong>of</strong> the air.14. There shall be compliance with applicable rules and regulations <strong>of</strong> the NorthCarolina Division <strong>of</strong> Environmental Management, North CarolinaSedimentation Control Commission, and with ordinances and regulations <strong>of</strong>various counties municipalities and other <strong>of</strong>ficial agencies relating topollution prevention and control.15. When any installation or maintenance operation disturbs the ground surfaceand the existing ground cover, Applicant agrees to remove and replace thesod or otherwise re-establish the grass cover to meet the satisfaction <strong>of</strong> thePublic Works Department.16. Applicant will have available at the construction site, at all times duringconstruction, a copy <strong>of</strong> this agreement showing evidence <strong>of</strong> approval by the<strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong>. The <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong> reserves the right to stop allwork unless evidence <strong>of</strong> approval can be shown.17. That in the case <strong>of</strong> noncompliance with the terms <strong>of</strong> this agreement by theApplicant, the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong> reserves the right to stop all work untilthe facility has been brought into compliance or removed from the right <strong>of</strong>way at no cost to the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong>.18. That it is agreed by both parties that this agreement shall become void ifactual construction <strong>of</strong> the work contemplated herein is not begun within six(6) months from the date or authorization by the <strong>Town</strong> <strong>of</strong> <strong>Kernersville</strong> unlesswritten waiver is secured by the Public Works Director from the <strong>Town</strong> <strong>of</strong><strong>Kernersville</strong>.
