A NEW ORDINANCE SECTION 16-19 OF THE CODE OF ORDINANCESOF THE TOWN OF KERNERSVILLE REQUIRING THATNEW SIDEWALK CONSTRUCTION BE IN A PROPER WORKMANLIKECONDITION PRIOR TO ISSUANCE OF A CERTIFICATE OF OCCUPANCYWHEREAS, the Board of Aldermen and/or the Ordinances, Rules, andRegulations of the Town of Kernersville periodically require that sidewalks be placedupon property being developed with residential and commercial structures; andWHEREAS, it appears to the Board of Aldermen that often times, prior to theissuance of a Certificate of Occupancy for the newly constructed residential/commercialstructure, there has been damage done to adjacent sidewalks during the course ofconstruction; andWHEREAS, it is only reasonable that the Town of Kernersville should accept, forfuture maintenance, only those sidewalks which are properly installed in a goodworkmanlike manner; andWHEREAS, it is in the best interest of the health, safety, and welfare of thecitizens of the Town of Kernersville that all sidewalks be and remain in a propercondition;NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE BOARD OFALDERMEN OF THE TOWN OF KERNERSVILLE that the Town Code of Ordinancesbe and are hereby amended to provide:“Section 16-19 Proper Condition of Sidewalks.(a) Every person or entity who/which constructs any newresidential/commercial structure within the Town of Kernersville,pursuant to requirement(s) of the Board of Aldermen, Ordinance(s), theTown of Kernersville Public Works Department DevelopmentGuidelines for Design and Construction and is required to install asidewalk adjacent thereto, shall do so in a proper workmanlike manneraccording to such requirement(s) of the Board of Aldermen,Ordinance(s), and/or the Town of Kernersville Public WorksDepartment Development Guidelines for Design and Construction;(b)The Head of the Town of Kernersville Inspection Division or his/herdesignee shall inspect each sidewalk adjacent to such new residential/commercial structure where a sidewalk is a requirement of the Board
(c)(d)of Aldermen, the Ordinance(s), and/or the Town of Kernersville PublicWorks Department Development Guidelines for Design andConstruction and the Building Inspections Division of the FireDepartment shall not issue a “Certificate of Occupancy” (“CO”) or“Building Final” approval for the structure until such required sidewalkis in a proper workmanlike condition free of any visual damage, or untila cash bond has been placed with the Town in accordance with theestimate of repair/construction by the Town of Kernersville PublicWorks Division;The owner and/or future occupant of the residential/commercialstructure subject to this Ordinance shall place the required sidewalk ina proper workmanlike condition, free of any visual damage, prior to theissuance of a Certificate of Occupancy;Every person(s) or entity(s) who/which own property upon whichthere is situate a driveway connection, any portion of whichencompasses a portion of or all of the sidewalk adjacent to saidproperty, shall keep that portion of the said driveway connection in aproper and safe condition for pedestrian travel and shall repair/replaceany such sidewalk which becomes damaged.This Ordinance shall be effective upon its date of adoption by the Board ofAldermen this ______ day of ____________________, 2000.Town of Kernersville__________________________MayorAttested to:Town ClerkAddendum 2
