Actual performance<br />

The Correctional Services Amendment Bill was certified<br />

by <strong>the</strong> Office <strong>of</strong> <strong>the</strong> Chief State Law Advisor on<br />

30/04/07 after <strong>the</strong> constitutionality <strong>of</strong> certain clauses<br />

was corrected. The Bill was published in <strong>the</strong> Government<br />

Gazette on 18/05/07 and introduced in Parliament.<br />

The first reading was on 29 August 2007, <strong>the</strong><br />

second reading on 18/10/07 after it had gone through<br />

<strong>the</strong> Portfolio Committee. The Bill was supported by<br />

all political <strong>part</strong>ies. It was processed through <strong>the</strong><br />

Select Committee during November 2007 and February<br />

2008 and was due <strong>to</strong> complete <strong>the</strong> final stage in<br />

2008/09.<br />

The De<strong>part</strong>ment does not have control on Parliamentary<br />

schedules and could <strong>the</strong>refore not achieve<br />

promulgation by 31 July 2007 as planned.<br />

Policy for Legal Services was approved by <strong>the</strong> Minister in<br />

March 2008.<br />

• 20 workshops / sessions on anti-corruption policies<br />

and procedures were conducted in <strong>the</strong> Regions:<br />

• EC: East London, Middledrift, Mthatha and<br />

St.Albans<br />

• KZN: Pietermaritzburg, Durban, Empangeni and<br />

Ncome<br />

• GP: Baviaanspoort and Zonderwater<br />

• LMN: Rooigrond, Polokwane and Rustenburg<br />

• FS / NC: Kroonstad, Grootvlei and Groenpunt<br />

• WC: Pollsmoor, George, Malmesbury, Goodwood<br />

and Drakenstein.<br />

• Two presentations were made <strong>to</strong> <strong>the</strong> Parole Board<br />

Chairpersons and deputy Chairpersons comprising<br />

116 attendants.<br />

• Promotional items were distributed <strong>to</strong> promote zero<br />

<strong>to</strong>lerance and anti-corruption awareness (bookmarks,<br />

stickers, posters, lanyards, folders, pens, memo clips<br />

and license disk holders.<br />

• The message distributed on all <strong>the</strong>se items calls<br />

upon everyone <strong>to</strong> fight fraud and corruption through<br />

reporting and <strong>to</strong> promote zero <strong>to</strong>lerance and includes<br />

<strong>the</strong> National Anti-Corruption Hotline <strong>to</strong>ll free number<br />

administered by <strong>the</strong> Office <strong>of</strong> <strong>the</strong> Public Service Commission.<br />

Many <strong>of</strong> <strong>the</strong> DCS investigations are referrals<br />

from <strong>the</strong> Hotline.<br />

Employees are being made aware <strong>of</strong> <strong>the</strong> DCS Anti-corruption<br />

strategy, anti-corruption policy and procedures, <strong>the</strong><br />

fraud prevention policy as well as <strong>the</strong> DCS whistle-blowing<br />

policy. It is intended that this will enc<strong>our</strong>age ethical behavi<strong>our</strong><br />

on <strong>the</strong> <strong>part</strong> <strong>of</strong> DCS employees.<br />

Implementations <strong>of</strong> recommendations were moni<strong>to</strong>red<br />

and reports submitted <strong>to</strong> executive management. More<br />

frequent reporting was impractical due <strong>to</strong> <strong>the</strong> fact that<br />

Management Areas have <strong>to</strong> be given time <strong>to</strong> implement<br />

recommendations made.
