Actual performance<br />

<strong>the</strong> De<strong>part</strong>ment has given final written warnings <strong>to</strong><br />

those <strong>of</strong>ficials who have admitted guilt. The final written<br />

warning is coupled with payment for loss suffered<br />

by <strong>the</strong> DCS as a result <strong>of</strong> fraud committed. Final<br />

written warning letters have already been issued <strong>to</strong><br />

353 <strong>of</strong>ficials who have also signed acknowledgement<br />

<strong>of</strong> debt with <strong>the</strong> De<strong>part</strong>ment through SIU. The <strong>to</strong>tal<br />

figure that will be recovered from <strong>the</strong> 353 <strong>of</strong>ficials is<br />

R6 454 100. In addition <strong>to</strong> <strong>the</strong> money owed, <strong>of</strong>ficials<br />

will also pay 25% <strong>of</strong> <strong>the</strong> money so owed <strong>to</strong> <strong>the</strong> Criminal<br />

<strong>As</strong>set Recovery Account (CARA). The KwaZulu-<br />

Natal Regional Office has taken over <strong>the</strong> process and<br />

once finalized disciplinary action will proceed against<br />

<strong>of</strong>ficials who did not admit guilt.<br />

The advantage <strong>of</strong> this process is that <strong>the</strong> DCS is put in<br />

a position where <strong>the</strong> <strong>of</strong>ficials involved have <strong>to</strong> repay <strong>the</strong><br />

money with which <strong>the</strong>y defrauded <strong>the</strong> De<strong>part</strong>ment.<br />

A trend analysis report for <strong>the</strong> period 1 March 2007<br />

– 30 September 2007 was produced. It was found<br />

that most <strong>of</strong> <strong>the</strong> transgressions related <strong>to</strong> dealings<br />

between <strong>of</strong>ficials and inmates. The transgressions<br />

related <strong>to</strong> dealing in drugs, exchange <strong>of</strong> money and<br />

o<strong>the</strong>r prohibited items. Although statistics were<br />

obtained from <strong>the</strong> Direc<strong>to</strong>rate: Employee Relations<br />

with regard <strong>to</strong> fraud, corruption and serious maladministration<br />

cases when compiling this report, it was<br />

evident that <strong>the</strong>ir classification <strong>of</strong> such cases differed<br />

with <strong>the</strong> classification by DIU and CEU. Consequently<br />

this made <strong>the</strong> analysis difficult. A recommendation<br />

was <strong>the</strong>refore made for Employee Relations <strong>to</strong> work<br />

with CEU and Information Management in developing<br />

an improved classification. The National Commissioner<br />

approved <strong>the</strong> recommendation and directed<br />

that <strong>the</strong> Direc<strong>to</strong>r: Employee Relations should lead <strong>the</strong><br />

process.<br />

Due <strong>to</strong> <strong>the</strong> fact that Employee Relations changed <strong>the</strong><br />

reporting format, it was difficult for CEU <strong>to</strong> produce<br />

<strong>the</strong> 2nd bi-annual trend analysis report <strong>to</strong> <strong>the</strong> executive<br />

management.<br />

Implementations <strong>of</strong> recommendations were moni<strong>to</strong>red<br />

and reports submitted <strong>to</strong> executive management.<br />

Seven workshops were conducted. O<strong>the</strong>r chairpersons<br />

who had already attended <strong>the</strong> basic training<br />

were trained on an advanced training c<strong>our</strong>se.<br />
