b) Ananias Ma<strong>the</strong> Escape – 13 members were<br />

charged in 1 hearing. A number <strong>of</strong> points in<br />

limine were raised during <strong>the</strong> hearing which<br />

started in 2007. Rulings were made in fav<strong>our</strong> <strong>of</strong><br />

<strong>the</strong> Employer. There are five (5) representatives<br />

representing <strong>the</strong> 13 employees and this impacts<br />

on <strong>the</strong> length <strong>of</strong> <strong>the</strong> trial which is still continuing<br />

in May 2008.<br />

c) Disciplinary hearings involving six (6) senior<br />

members <strong>of</strong> <strong>the</strong> DCS were dealt with: Two written<br />

warnings, one final written warning, one dismissal,<br />

one acquittal and <strong>the</strong> o<strong>the</strong>r one resigned<br />

after receiving a letter <strong>of</strong> demotion.<br />

d) The Helderstroom case where 16 <strong>of</strong>ficials were<br />

dismissed for assault which resulted in <strong>the</strong> death<br />

<strong>of</strong> an inmate.<br />

The hearings and <strong>the</strong> sanctions imposed instil discipline<br />

within <strong>the</strong> DCS, and emphasizes <strong>the</strong> De<strong>part</strong>ment’s stance<br />

<strong>of</strong> zero-<strong>to</strong>lerance against corruption.<br />

• The Jali Commission recommendations relating <strong>to</strong><br />

disciplinary hearing cases have been finalized. The<br />

interim report recommended action <strong>to</strong> be taken<br />

against 94 <strong>of</strong>ficials. The outcome <strong>of</strong> <strong>the</strong> disciplinary<br />

hearing cases were as follows: 43 dismissals, 18<br />

written warnings, 26 cases withdrawn (due lack <strong>of</strong><br />

evidence or non-availability <strong>of</strong> witnesses) and seven<br />

resignations.<br />

• The final report recommended disciplinary action <strong>to</strong><br />

be taken against 106 <strong>of</strong>ficials. The outcome <strong>of</strong> <strong>the</strong><br />

disciplinary hearing cases were as follows: 2 dismissals,<br />

21 written warnings, 41 withdrawn (due lack <strong>of</strong><br />

evidence or non-availability <strong>of</strong> witnesses), 10 acquittals,<br />

5 counselling, 20 resignations and 7 deceased.<br />

• One <strong>of</strong> <strong>the</strong> challenges faced with <strong>the</strong>se cases was <strong>the</strong><br />

availability <strong>of</strong> chairpersons who got held up in <strong>the</strong>ir<br />

o<strong>the</strong>r line function duties which are in <strong>the</strong>ir workplans<br />

/ performance agreements. In order <strong>to</strong> overcome<br />

this a strategy was developed in terms <strong>of</strong> which this<br />

project had <strong>to</strong> form <strong>part</strong> <strong>of</strong> identified <strong>of</strong>ficials’ workplans<br />

/ performance agreements, and <strong>the</strong>y also had<br />

<strong>to</strong> be assessed on that activity.<br />

The attitude by <strong>the</strong> De<strong>part</strong>ment in implementing <strong>the</strong> Jali<br />

Commission recommendations is a demonstration <strong>of</strong> its<br />

<strong>commitment</strong> <strong>to</strong> enhancing its management, reputation<br />

and integrity, and also its stance <strong>of</strong> zero-<strong>to</strong>lerance against<br />

corruption.<br />

MEDCOR fraud cases: These are also cases that<br />

emanated from <strong>the</strong> Jali Commission <strong>of</strong> enquiry. The<br />

Direc<strong>to</strong>rate <strong>of</strong> Special Operations (DSO), <strong>the</strong> South<br />

African Police Services (SAPS) and <strong>the</strong> Special Investigations<br />

Unit (SIU) assisted <strong>the</strong> De<strong>part</strong>ment with <strong>the</strong><br />

investigation. 701 <strong>of</strong>ficials, working with doc<strong>to</strong>rs and<br />

nurses, were found <strong>to</strong> have been involved in medical<br />

aid fraud. Whilst criminal prosecution is proceeding
