<strong>M6</strong> GROUP PRESENTATIONAs a network which is financed exclusively by advertising, it is subject <strong>to</strong> <strong>the</strong> general requirements of thislegal classification and <strong>to</strong> <strong>the</strong> special terms and conditions of its broadcasting licence.<strong>M6</strong>’s broadcasting licence was renewed in July 1996 and July 2001 for two consecutive terms of fiveyears from 1 March 1997 and 1 January 2002. These broadcasting licence renewals were <strong>the</strong> subject ofnegotiations with <strong>the</strong> CSA in accordance with <strong>the</strong> provisions of <strong>the</strong> Law of 30 September 1986.On 10 June 2003, <strong>M6</strong> received an authorisation <strong>to</strong> continue its terrestrial digital service, effective from 31March 2005. As a result, <strong>M6</strong> authorisation was renewed until 28 February <strong>2012</strong>, in accordance withArticle 82 <strong>the</strong> Law 2000-719 of 1 August 2000.In addition, <strong>M6</strong> received a fur<strong>the</strong>r five-year authorisation from <strong>the</strong> termination of its analogue service, asits terrestrial digital service at 30 November 2011 had been extended <strong>to</strong> 95% of Metropolitan Franceterri<strong>to</strong>ry. This is complemented by a minimum coverage of 91% of every district.Lastly, by a ruling of <strong>the</strong> CSA (Conseil supérieur de l’audiovisuel) on 8 January 2013 and pursuant <strong>to</strong>Article 99 of <strong>the</strong> amended Law of 30 September 1986, <strong>the</strong> <strong>M6</strong> licence was extended by a duration of fiveyears owing <strong>to</strong> its participation in <strong>the</strong> public interest group established <strong>to</strong> phase out analoguebroadcasting.The channel’s service has been broadcast in High Definition since 31 Oc<strong>to</strong>ber 2008.b) W9W9 is a privately owned free-<strong>to</strong>-air terrestrial TV network which was initially licensed <strong>to</strong> broadcast for aduration of ten years from 10 June 2003 (call for tender of 24 July 2001) under <strong>the</strong> licencing regime setforth by Article 30 of <strong>the</strong> amended Law of 30 September 1986 on Freedom of Communication. W9 waslaunched on 31 March 2005.W9’s broadcasting licence was renewed for five years, i.e. until 30 March 2020, pursuant <strong>to</strong> Article 97 of<strong>the</strong> above-mentioned Law, in return for extending its effective coverage of Mainland France <strong>to</strong> 95%. Thisalso requires that at least 91% of every district be covered.c) 6ter6ter is a privately owned free-<strong>to</strong>-air high definition nationwide terrestrial TV network, which was licensed<strong>to</strong> broadcast on 3 July <strong>2012</strong> for a duration of ten years from 12 December <strong>2012</strong> (expiring on 11December 2022) under <strong>the</strong> licensing regime set forth by Article 30 of <strong>the</strong> amended Law of 30 September1986 on Freedom of Communication.d) O<strong>the</strong>r licencesThe <strong>M6</strong> Group also hold licences for <strong>the</strong> Paris Première and TF6 pay channel, with <strong>the</strong> latter being jointlycontrolledwith TF1.1.6.2.3. Investment obligations in <strong>the</strong> production of audiovisual andcinema<strong>to</strong>graphic works and broadcastingThe channels’ investment obligations in audiovisual and cinema productions, as well as <strong>the</strong>ir broadcastingobligations are defined by Decree No. 2010-747 of 2 July 2010, known as <strong>the</strong> “Production” decree,Decree No. 90-66 of 17 January 1990, as amended, known as <strong>the</strong> “Broadcasting” decree, andagreements signed with <strong>the</strong> Conseil Supérieur de l’Audiovisuel.a) Provisions applicable <strong>to</strong> <strong>M6</strong>The <strong>M6</strong>’s channel regime for obligations in <strong>2012</strong> was as follows:<strong>M6</strong> GROUP - <strong>2012</strong> REGISTRATION DOCUMENT - 43
