<strong>M6</strong> GROUP PRESENTATIONThe amendment <strong>to</strong> W9’s agreement sets <strong>the</strong> number of original programmes <strong>to</strong> be broadcast in audiodescriptionat 6 in <strong>2012</strong> and 12 from 2013 onwards.6ter’s licence did not impose any obligations on <strong>the</strong> channel in <strong>2012</strong>.• Signalling codeAs part of its mission <strong>to</strong> protect young viewers, <strong>the</strong> CSA has established a rating system for programmesand a signalling code, which <strong>M6</strong> Group’s channels must adhere <strong>to</strong>. Channels may broadcastprogrammes aimed at all audiences, and, depending on broadcasting time, category II (viewers must beat least 10 year olds), III (+12) and IV (+16). <strong>M6</strong> and W9 are not authorised <strong>to</strong> broadcast programmesclassified as category V (+18).6ter is not permitted <strong>to</strong> broadcast category III programmes before 10pm and is not authorised <strong>to</strong>broadcast category IV programmes.• Advertising commitmentsConcerning advertising, <strong>the</strong> Law n° 93-122 of 22 January 1993 (<strong>the</strong> "Loi Sapin”) governs <strong>the</strong> relationshipbetween advertisers, <strong>the</strong>ir agents and <strong>the</strong> advertising media.O<strong>the</strong>r regulations that relate <strong>to</strong> <strong>the</strong> broadcasting of advertising spots arise from <strong>the</strong> Code of PublicHealth, from <strong>the</strong> Law of 30 September 1986 already mentioned, and from Decree n° 92-280 of 27 March1992. It should be noted that as of 27 February 2007, advertising or promotional messages for certainfoods and beverages must be accompanied by relevant health information.A number of amendments were made between 2008 and 2010 <strong>to</strong> <strong>the</strong> advertising regulations that apply<strong>to</strong> <strong>M6</strong> and W9.The Decree n°92-280 of 27 March 1992, amended by <strong>the</strong> Decree n° 2008-1392 of 19 December 2008,set <strong>the</strong> regulations applying <strong>to</strong> television advertising, self-promotion and teleshopping and authorised:- an extension of <strong>the</strong> average advertising time allowable during one hour from 6 <strong>to</strong> 9 minutes, with<strong>the</strong> maximum allowable hourly advertising time remaining at 12 minutes;- a change in <strong>the</strong> method of counting, clock time replacing moving time.In addition, <strong>the</strong> Law n°2009-258 of 5 March 2009 relating <strong>to</strong> audiovisual communication and new publictelevision services proceeded with:- <strong>the</strong> reform of <strong>the</strong> public television service by providing for <strong>the</strong> partial elimination of commercialadvertising on <strong>the</strong> national channels of France Télévisions between 8pm and 6am with effect from 5January 2009;- <strong>the</strong> transposition of <strong>the</strong> SMA Directive by extending <strong>the</strong> competence of <strong>the</strong> CSA <strong>to</strong> on-demandaudiovisual media services,and also provided for:- <strong>the</strong> introduction of a second advertisement break during audiovisual and cinema<strong>to</strong>graphic works;- <strong>the</strong> authorisation of product placement, in accordance with <strong>the</strong> terms and conditions defined by <strong>the</strong>CSA in its decision dated 16 February 2010, amended by its decision dated 24 July <strong>2012</strong>. It statesthat product placement is authorised within this framework in film works, audiovisual drama andmusic videos, providing <strong>the</strong>se programmes are not intended for children.With regard <strong>to</strong> 6ter, <strong>the</strong> channel is not permitted <strong>to</strong> broadcast advertisements before 10pm that promotevideos games and videogrammes of works that are prohibited or not recommended for <strong>the</strong> under 12s.<strong>M6</strong> GROUP - <strong>2012</strong> REGISTRATION DOCUMENT - 47
