<strong>M6</strong> GROUP PRESENTATIONc) Provision applicable <strong>to</strong> 6ter Cinema<strong>to</strong>graphic and audiovisual obligationsHaving only been launched on 12 December <strong>2012</strong>, <strong>the</strong> channel 6ter was not subject <strong>to</strong> productionobligations for <strong>the</strong> year <strong>2012</strong>. Its broadcasting licence stipulates that it must invest 15% of its net annualrevenue in audiovisual production and 9% in <strong>the</strong> production of heritage works, with a guaranteedminimum of €6 million over <strong>the</strong> first three years.In addition, at least 3.2% of net annual revenue will be invested in <strong>the</strong> development of Europeancinema<strong>to</strong>graphic production, including 2.5% in original French language works. Broadcasting obligations- In any 24 hour period, a minimum of 40% of audiovisual works broadcast must be original Frenchlanguage and 60% must be European, and <strong>the</strong> same requirements apply <strong>to</strong> peak viewing times(between 6.30am and 9am inclusive and between 6pm and 11pm inclusive).- A minimum of 60% of <strong>to</strong>tal transmission time must be devoted <strong>to</strong> magazine programmes and<strong>document</strong>aries on <strong>the</strong> one hand, and <strong>to</strong> fiction on <strong>the</strong> o<strong>the</strong>r, with <strong>the</strong> two genres evenly split.- To broadcast no more than 192 hours of cinema<strong>to</strong>graphic works during <strong>the</strong> year of which 144 mustbe between 8.30pm and 10.30pm. Cinema<strong>to</strong>graphic works must comply with <strong>the</strong> broadcastingquotas throughout <strong>the</strong> day and during peak viewing times, i.e. 40% original French language worksand 60% European works. Discovery programming obligationobligations- To broadcast 100 hours of programming devoted <strong>to</strong> educational programmes, which comprisesmagazine programmes, game shows, <strong>document</strong>aries, fiction and animation.a) Accessibility of programmes1.6.2.4. O<strong>the</strong>r obligations common <strong>to</strong> <strong>M6</strong>, W9 and 6ter Deaf and hard of hearingIn accordance with <strong>the</strong> obligations set by Law n°2005-102 for equal rights, opportunities, participationand citizenship of <strong>the</strong> disabled, obligations in respect of broadcasting subtitled programmes require thatall programmes on channels with an audience ratings of more than 2.5% are made accessible <strong>to</strong> <strong>the</strong> deafand hard-of-hearing, with <strong>the</strong> exception of advertising slots, self-promotion messages, live singingperformances and instrumental music pieces, trailers, teleshopping and commentaries on live broadcastsof sporting events between midnight and 6 am, via a progressive increase until 2010.In <strong>2012</strong>, <strong>M6</strong> and W9 subtitled all its programming (excluding above-mentioned exceptions).6ter’s licence did not impose any obligations on <strong>the</strong> channel in <strong>2012</strong>. Blind or visually impairedPursuant <strong>to</strong> <strong>the</strong> provisions of Articles 28 and 33-1 of <strong>the</strong> Law of 30 September 1986 arising from <strong>the</strong>above-mentioned Law n°2005-102, on 7 Oc<strong>to</strong>ber 2011 <strong>the</strong> CSA and <strong>M6</strong> signed an amendment <strong>to</strong> <strong>the</strong>Channel’s agreement <strong>to</strong> include obligations for <strong>the</strong> broadcasting of programmes in audio-description. Thenumber of original programmes <strong>to</strong> be broadcast with audio-description in <strong>2012</strong> was set at twelve, and,from 2013 onwards at 52 programmes per year, of which 20 must be original with audio-description. Thestakeholders are <strong>to</strong> pay particular attention <strong>to</strong> peak viewing times and programmes aimed at children andteenagers.46 - <strong>M6</strong> GROUP - <strong>2012</strong> REGISTRATION DOCUMENT
