<strong>M6</strong> GROUP PRESENTATIONb) Provisions applicable <strong>to</strong> W9The W9 channel’s regime for obligations in 2011 was as follows: Audiovisual production• Invest 14.5% of net advertising revenue of <strong>the</strong> previous year in <strong>the</strong> production of Europeanaudiovisual works or original French language works, including at least 7.5% of net annualadvertising revenue must be invested in heritage works which are defined as works relating <strong>to</strong> <strong>the</strong>following categories: drama, animation, creative <strong>document</strong>aries, including those which arebroadcast within a programme o<strong>the</strong>r than a newscast or entertainment programme, music videosand broadcasting or re-enactment of live shows.• European heritage works which are not original French language works may not account for morethan 20% of <strong>the</strong> overall obligation and more than 20% of investment in heritage films. Thisrequirement applies until net revenue for <strong>the</strong> previous year does not exceed €100 million.• 70% of <strong>the</strong> overall obligation and 75% of investment in heritage work must be devoted <strong>to</strong>productions deemed independent.• 25% of <strong>the</strong> contribution <strong>to</strong> audiovisual production must be invested in European works or in neworiginal French language works (investment in feature-length drama, music videos and animationare excluded).• Dedicate at least 5% of net annual revenue of <strong>the</strong> previous year <strong>to</strong> original French language orEuropean music. Cinema<strong>to</strong>graphic production• To invest at least 3.2% of its annual revenue in <strong>the</strong> development of <strong>the</strong> production of Europeancinema<strong>to</strong>graphic works, of which 2.5% must be dedicated <strong>to</strong> <strong>the</strong> development of original Frenchlanguage cinema<strong>to</strong>graphic works,• 75% invested in pre-purchase or co-production must be dedicated <strong>to</strong> cinema<strong>to</strong>graphic works thatare independently produced. Broadcasting obligations- In any 24 hour period, a minimum of 40% of audiovisual works broadcast must be original Frenchlanguage, and 60% must be European, and <strong>the</strong> same requirements apply <strong>to</strong> peak viewing periodsbetween 10 am and 12.30pm between 5pm and 11pm.- To broadcast no more than 192 hours of cinema<strong>to</strong>graphic works during <strong>the</strong> year of which 144hours must be during peak viewing period from 8.30pm <strong>to</strong> 10.30pm. Cinema<strong>to</strong>graphic works mustcomply with <strong>the</strong> broadcasting quotas throughout <strong>the</strong> day and for peak viewing hours (8.30pm <strong>to</strong>10.30pm), i.e. 40% of original French language works and 60% of European origin. Musical programming obligationsW9’s agreement states that its programming primarily focuses on mainstream music, aimed morespecifically at young adults. W9’s programming is open <strong>to</strong> diverse types of music and includes <strong>the</strong>broadcasting of at least 52 live shows per year.<strong>M6</strong> GROUP - <strong>2012</strong> REGISTRATION DOCUMENT - 45
