i. MTs <strong>and</strong> AGR <strong>Soldier</strong>s will be selected, assigned, trained <strong>and</strong> promoted in a concerted effort between the StatesMPMO, HRO <strong>and</strong> plans, operations, <strong>and</strong> training officers to assure equitable management. Although they may beassigned to positions identified only for members of these programs, their promotion sequence will be determined perparagraph 7–39h(2); if AGR SFC or MSG, a controlled grade allocation is available to promote the <strong>Soldier</strong>.j. Specialists who are in the selection objective of the promotion list for their CPMOS <strong>and</strong> have completed WLCmay be trained <strong>and</strong> then concurrently awarded SQI 4. They may be assigned as described in NGR 600–200, chapter 4to AGR recruiting <strong>and</strong> retention NCO positions, <strong>and</strong> promoted to SGT against the recruiting <strong>and</strong> retention positionauthorization. <strong>Soldier</strong>s assigned to recruiting <strong>and</strong> retention positions (SQI 4) compete against other <strong>Soldier</strong>s with SQI 4in sequence as they appear on the promotion list. <strong>Soldier</strong>s who are removed from the recruiting <strong>and</strong> retention positions(SQI 4) prior to the completion of 12 months will be reduced per chapter 10 of this regulation.7–40. Selecting <strong>Soldier</strong>s from promotion listsNGR 600–200, chapter 4, covers the assignment <strong>and</strong> chapter 3 refers to utilization of <strong>Soldier</strong>s. Use that guidance <strong>and</strong>the following policies, procedures <strong>and</strong> options to fill positions. State MPMOs will ensure senior grade vacancies arefilled without delay. Failure to fill valid vacancies in a timely manner has a direct impact on the unit status report <strong>and</strong>the overall unit retention program.a. <strong>Soldier</strong>s will be offered assignment to available vacancies for which they are eligible <strong>and</strong> available starting withthe lowest promotion sequence number (having the most points) within each CPMOS <strong>and</strong> continuing until the selectionobjective is exhausted, all vacancies are filled, or the list expires. AGR <strong>Soldier</strong>s only compete against other AGR<strong>Soldier</strong>s within the same CPMOS. Traditional (M-day) <strong>Soldier</strong>s compete for vacancies with other M-day <strong>Soldier</strong>s toinclude MT. If <strong>Soldier</strong>s are eligible <strong>and</strong> available for the assignment, they will be assigned <strong>and</strong> promoted provided theyhave met all other requirements for the promotion. 1SGs <strong>and</strong> MSGs on the SGM promotion list for CSM will beeligible <strong>and</strong> available for MOS 00Z assignments, <strong>and</strong> immediate promotion concurrent with assignments only afterapproval by the HQDA (NGB) ARNG CSM selection board per NGR 600–200, chapter 9. SFCs on the MSGpromotion list <strong>and</strong> the 1SG selection list are eligible for immediate promotion concurrent with assignment to 1SGpositions. <strong>Soldier</strong>s who are in FLAG status are not eligible for selection until the FLAG is closed. These <strong>Soldier</strong>s willnot be contacted for assignment to higher graded positions while in a FLAG status. States will establish procedures tocontact <strong>and</strong> solicit individual responses (acceptance or declination) only from eligible <strong>and</strong> available <strong>Soldier</strong>s who haveselected an option to serve at a unit or location or within an area or distance, including allowable response times (<strong>and</strong>the consequences of failure to respond). Guidance on the options is in paragraphs 7–29 <strong>and</strong> 7–31. State MPMOs willensure that additional criteria or unauthorized screening criteria or procedures not specified in, or authorized by, thischapter are not added to this process. This includes selecting <strong>Soldier</strong>s out of sequence through an unauthorizedinterview process. Exceptions are CSM/1SG “best qualified” leadership boards. States who conduct monthly orquarterly selection boards to fill NCO vacancies without soliciting <strong>Soldier</strong>s (acceptance or declination) must eitherforward notification to all <strong>Soldier</strong>s selected or post results on a public site accessible to M-Day <strong>Soldier</strong>s. In addition,<strong>Soldier</strong>s selected will be provided a reasonable time (min of 30 days) to decline the position for which selected.b. <strong>Soldier</strong>s within the published commuting distance (50 miles from the <strong>Soldier</strong>’s residence unless another st<strong>and</strong>ardhas been established by the State AG) must accept promotion <strong>and</strong> assignment to positions for which they are eligible(qualified) <strong>and</strong> available. Failure to accept the position will result in removal from the promotion list.(1) The travel distance <strong>and</strong> time rules for involuntary assignment in AR 135–91, paragraph 5–5, are designed toensure safe, reasonable requirements for <strong>Soldier</strong>s <strong>and</strong> the even application of rules to all <strong>Soldier</strong>s on that list.(2) No one other than the convening authority may add a requirement for the assignment or promotion that is not setin the MTOE/TDA. States or convening authority are authorized to consider SQI when the requirement is deemedmission essential. However, these criteria must be set within the annual MOI prior to the promotion board. St<strong>and</strong>ardspublished by the State will conform to the limits in NGR 600–200 <strong>and</strong> this chapter. These requirements will apply toall <strong>Soldier</strong>s in the grade or grades for which the st<strong>and</strong>ards are set.(3) AGR <strong>Soldier</strong>s are not subject to the commuting distance st<strong>and</strong>ard. They are eligible for State-wide reassignment<strong>and</strong> PCS move per NGR 600–5 <strong>and</strong> the Joint Federal Travel Regulation when selected for promotion <strong>and</strong> reassignment.(4) <strong>Soldier</strong>s serving in assignments that have a service requirement, such as an AGR who made a permanent PCSmove may not be eligible or available for many assignments because of the restriction on subsequent PCS movesalthough otherwise fully qualified for promotion.c. <strong>Soldier</strong>s selected for assignments when they are fully qualified will be promoted concurrently with the assignment.They may not be assigned to positions or promoted in the position until the incumbent is reassigned or separated.Comm<strong>and</strong>ers are authorized to have a promotion ceremony at the <strong>Soldier</strong>’s current unit immediately before reassignmentper paragraph 7–13a. In the case of AGR personnel, States are authorized to fill the incumbent’s position the daythe incumbent begins transition leave or permissive TDY. However, States can not exceed their control gradeauthorization. Orders may be published in advance of the actual vacancy to allow planning <strong>and</strong> processing, but theeffective date of the <strong>Soldier</strong>’s promotion <strong>and</strong> assignment to the position will not be earlier than the day after theincumbent leaves the position.d. AGR SFC <strong>and</strong> MSG selected <strong>and</strong> assigned to funded positions, but for whom there are no available controlledgrade allocations to promote, will remain assigned pending availability of a control grade resource. <strong>Soldier</strong>s in thisAR 600–8–19 • 20 March 2008123
