commuting distance (as defined in AR 140-10, paragraph 1-10). The <strong>Soldier</strong>, after removal from the recommended list,is nonpromotable for one year.(15) Is a Reserve Component <strong>Soldier</strong> previously scheduled for m<strong>and</strong>atory removal because of age, years of serviceor not selected for retention by a qualitative retention board.b. Because HRC-Alex<strong>and</strong>ria, HRC-St. Louis, <strong>and</strong> Regional Readiness Comm<strong>and</strong>s (RRCs) administer promotions togrades SFC through sergeant major (SGM), CDRs are responsible for notifying HRC-Alex<strong>and</strong>ria (AHRC-MSP-E),HRC-St. Louis (AHRC-MSL-E) or RRCs when <strong>Soldier</strong>s in those grades whose names appear on a recommended listbecome nonpromotable. When a <strong>Soldier</strong> has been flagged under the provisions of AR 600-8-2, CDRs must forwarddocumentation, to include the initial DA Form 268, explaining the reason for the flagging action. When the flaggingaction is closed, the PROM will forward a copy of the final DA Form 268, the date the flag is closed, type ofpunishment received, date all punishment is completed (including all periods of suspension), <strong>and</strong>/or date that amemor<strong>and</strong>um of reprim<strong>and</strong> was approved for filing. For all other cases, the PROM will provide the <strong>Soldier</strong>’s name <strong>and</strong>a brief summary of circumstances that caused the <strong>Soldier</strong> to become nonpromotable. All correspondence will be mailedto Comm<strong>and</strong>er, HRC-Alex<strong>and</strong>ria, ATTN: AHRC-MSP-E, 200 Stovall Street, Alex<strong>and</strong>ria, VA 22332-0443, Comm<strong>and</strong>er,HRC-St. Louis ATTN: AHRC-MSL-E, 1 Reserve Way, St. Louis, MO 63132-5200 or to the RRC <strong>and</strong> will includethe <strong>Soldier</strong>’s sequence number, promotion MOS, <strong>and</strong> the date the <strong>Soldier</strong> became nonpromotable.1–11. Delay of promotion due to suspension of favorable personnel actions for <strong>Soldier</strong>s on acentralized promotion listWhen a delay of promotion has occurred because of suspension of favorable personnel actions, the following rulesapply once the final DA Form 268 has been prepared. The <strong>Soldier</strong>’s promotion status will be determined as follows:a. If the FLAG is lifted with the disposition, Case is closed favorably, <strong>and</strong> he or she would have been promotedwhile the suspension of favorable personnel actions was in effect, provided otherwise qualified, he or she will bepromoted. Effective date <strong>and</strong> date of rank (DOR) will be the date the <strong>Soldier</strong> would otherwise have been promoted.b. If the <strong>Soldier</strong>’s final report is closed with “Disciplinary action taken,” <strong>and</strong> he or she would have been promotedwhile the suspension of favorable personnel actions was in effect, provided otherwise qualified, he or she will bepromoted unless action has been initiated to remove the <strong>Soldier</strong> from the recommended list. Effective date <strong>and</strong> DORwill be the date following the removal of the suspension of personnel actions.c. If the <strong>Soldier</strong>’s final report is closed with “Other” (applies to the Army Weight Control Program, the ArmyPhysical Fitness Test (APFT), <strong>and</strong> the ASAP), <strong>and</strong> he or she would have been promoted while suspension of favorablepersonnel actions was in effect, provided otherwise eligible, he or she will be promoted. Effective date <strong>and</strong> DOR willbe the effective date of the removal of the suspension of favorable personnel action.d. Effective date <strong>and</strong> DOR stated on a promotion instrument (orders or DA Form 4187 (Personnel Action)) will bethe same. The effective date reflected on the promotion instrument will be the effective date used on the grade change(GRCH) transaction unless otherwise specified in this regulation.1–12. Precedence of relative rankAmong enlisted <strong>Soldier</strong>s of the same grade of rank in active military service (to include retired enlisted <strong>Soldier</strong>s onactive duty, drill status or FTNGD for ARNG), precedence or relative rank will be determined as follows:a. According to DOR.b. By length of active Federal service in the Army when DORs are the same (pay entry basic date (PEBD) forUSAR <strong>and</strong> ARNG)c. By length of total active Federal service when 1–12a <strong>and</strong> b are the same.d. By date of birth when 1–12a, b, <strong>and</strong> c are the same. Older is more senior.1–13. Date of rank <strong>and</strong> effective datea. The DOR for promotion to a higher grade is the date specified in the promotion instrument or, when no date isspecified, is the date of the instrument of promotion.b. The DOR in all other cases will be established as governed by appropriate regulation.c. The DOR in a grade to which reduced for inefficiency, voluntary reduction, or failure to complete a school courseis the same as that previously held in that grade.d. The DOR on reduction for all other reasons is the effective date of reduction (see para 10–13).e. The DOR <strong>and</strong> effective date will be the same, unless otherwise directed by this regulation. If the effective date isprior to the date of the promotion instrument in the case of <strong>Soldier</strong>s being promoted to—(1) The grades of PV2 through SPC, a DA Form 4187 will be initiated by the <strong>Soldier</strong>’s appropriate CDR <strong>and</strong> sent tothe next higher promotion authority requesting that the <strong>Soldier</strong> be promoted with a retroactive date, explaining thespecific reason for the delay in promotion. If the next higher promotion authority approves the request, he or she willso indicate by DA Form 4187–1–R (Personnel Action Form Addendum) <strong>and</strong> direct the <strong>Soldier</strong>’s promotion, indicatingthe correct effective date. (2) The grades of SGT <strong>and</strong> SSG, the promotions section will initiate a DA Form 4187 or memor<strong>and</strong>um to thepromotion authority, explaining the specific reason for the delay. The DA Form 4187 or memor<strong>and</strong>um will be signedby the personnel detachment (PD) CDR or officer in charge. Once the promotion authority approves the request, he orshe will so indicate by DA Form 4187–1–R or memor<strong>and</strong>um to the promotions section. The promotions section willthen publish the promotion order. The promotion order will cite, along with other applicable authority, DA Form4187–1–R or the memor<strong>and</strong>um. DA Form 4187 or memor<strong>and</strong>um, approved DA Form 4187–1–R or memor<strong>and</strong>um, <strong>and</strong>promotion instrument will be filed in the MPF.(3) The grades of SFC through SGM, an annotation will be entered in the DA-controlled sequence roster, explainingthe specific reason for the delay. CDR, HRC–Alex<strong>and</strong>ria (AHRC–MSP–E), CDR, HRC–St. Louis (AHRC–MSL–E) orCDR, Regional <strong>Support</strong> Comm<strong>and</strong>/Army Reserve Comm<strong>and</strong> (RSC/ARCOM) will publish the promotion order oramendment with the correct effective date.f. For <strong>Soldier</strong>s promoted to PV2 through SGM entitled to a promotion effective date that exceeds 6 months prior tothe date of the promotion instrument, the following will be entered in the special instructions: Because the effectivedate of the promotion exceeds this instrument by more than 6 months, the Defense Joint Military Pay System willautomatically pay up to 12 months of backpay entitlements. Your next leave <strong>and</strong> earnings statement will reflect suchpayment. If you are due backpay in excess of 12 months, upon receipt of your leave <strong>and</strong> earnings statement thatreflects backpay, provide your servicing Finance <strong>and</strong> Accounting Office (FAO) with a copy of the instrument. Yourservicing FAO will initiate procedures under the provisions of the DOD Financial Management Regulation 7000.14–R,volume 7A, table 2–2, rule number 5, which will result in you receiving any additional back pay to which you areentitled.g. This paragraph will not be used to promote <strong>Soldier</strong>s retroactively because of errors discovered during computation,reevaluation, or administrative adjustment (applies to USAR <strong>and</strong> ARNG).h.
