(g) Was considered in error (no exception authorized).(h) Was recommended by an approved reduction board to be removed from a promotion list.(i) Declines promotion in accordance with this regulation.(j) Is defined as failing to attend, having failed to complete for cause or academic reasons or being deniedenrollment to the required NCOES course for cause.(k) Is a SFC (promotable) (P) or MSG(P) who lost his/her security clearances for cause, or is permanentlydisqualified from receiving a security clearance.(l) Has a qualifying conviction for domestic violence under the Lautenberg Amendment in accordance with AR 600-20.b. Rules for processing comm<strong>and</strong> initiated removals.(1) Any CDR in the <strong>Soldier</strong>’s chain of comm<strong>and</strong> may recommend that a <strong>Soldier</strong>’s name be removed from a HQDArecommended list at any time. The recommendation for removal must be fully documented <strong>and</strong> justified. DA Form 268will be initiated at this time.(2) When recommending a <strong>Soldier</strong> for removal, CDRs will evaluate circumstances to ensure that all other appropriateactions have been taken (training, supervision, <strong>and</strong> formal counseling have not helped) or the basis for consideringremoval is serious enough to warrant denying the individual’s promotion.(3) <strong>Soldier</strong>s flagged for noncompliance with AR 600–9. The CDR must submit a recommendation for removal on a<strong>Soldier</strong> who has not met the weight requirements within the time prescribed in AR 600–9, provided no underlying orassociated disease is found to be the cause of the overweight condition.(4) Recommendation may be submitted for subst<strong>and</strong>ard performance.(5) Removal actions, to include rebuttal, will be processed in accordance with steps in table 4–4.(6) The removal action will be submitted for review through comm<strong>and</strong> channels to the CDR having general courtmartialconvening authority (GCMCA) or the first general officer in the chain of comm<strong>and</strong> having a staff judgeadvocate on his or her staff.(7) Recommendation may be disapproved at any level of comm<strong>and</strong>. The disapproval will be returned throughcomm<strong>and</strong> channels to the originator with the reason for disapproval.(8) All actions will be forwarded to HRC–Alex<strong>and</strong>ria (AHRC–MSP–E) (HRC–St. Louis (AHRC–MSL–E) forUSAR) in duplicate <strong>and</strong> will include a copy of his/her PQR, <strong>and</strong> DA Form 268.(9) HRC–Alex<strong>and</strong>ria (AHRC–MSP–E) (HRC–St. Louis (AHRC–MSL–E) for USAR) will notify the appropriateCDR of the results <strong>and</strong> recommendations of the STAB.4–16. The <strong>Soldier</strong> will be allowed to respond to the proposed action <strong>and</strong> may submita rebuttal within 15 duty days after receipt of the written notification. This time will be extendedonly for reasons beyond the <strong>Soldier</strong>’s control.8 BN HR Review action <strong>and</strong> obtain the battalion CDR’s recommendation <strong>and</strong> signature.9 BN HR Forward the action through comm<strong>and</strong> channels for recommendations <strong>and</strong> then forward to thePROM.10 PROM Reviews action for compliance.60 AR 600–8–19 • 20 March 2008

HRC–Alex<strong>and</strong>ria (AHRC–MSP–E) (HRC–St. Louis (AHRC–MSL–E) for USAR) will continuouslyreview promotion lists against all information available to ensure that no <strong>Soldier</strong> is promoted where there is cause tobelieve that a <strong>Soldier</strong> is mentally, physically, morally, or professionally unqualified to perform duties of the highergrade.b. Basis for referral. In addition to paragraph 4–17a, a <strong>Soldier</strong> may be referred to a STAB for the following reasons.This list is not all inclusive.(1) Article 15 directed for filing in the OMPF.(2) A memor<strong>and</strong>um of reprim<strong>and</strong> placed in the OMPF.(3) Adverse documentation filed in the OMPF.(4) <strong>Soldier</strong>s who are flagged in accordance with AR 600–8–2 <strong>and</strong> have not met the requirements in the timeprescribed by that regulation.(5) Other derogatory information received by HQDA, but not filed in the OMPF, if it is substantiated, relevant, <strong>and</strong>might reasonably <strong>and</strong> materially affect a promotion recommendation.(6) Relief-for-cause NCOER.c. Notice. A <strong>Soldier</strong> referred to a STAB normally will be considered by the STAB within 120 calendar days afterthe case is referred for review. Before the STAB convenes, the <strong>Soldier</strong> will be informed, by memor<strong>and</strong>um, of thereason for the action <strong>and</strong> provided a copy of the information that will be considered by the board. The <strong>Soldier</strong> will begiven reasonable opportunity, not less than 30 duty days from the date of receipt of the information, to submitcomments to the STAB <strong>and</strong> the official(s) reviewing the recommendation. If the <strong>Soldier</strong> cannot be given access to theinformation for reasons of national security, the <strong>Soldier</strong> will, to the maximum extent possible, be provided with anappropriate summary of the information.d. Information considered. A STAB will consider—(1) The <strong>Soldier</strong>’s OMPF, in addition to the documents contained in the removal action.(2) Any submission to the board by the <strong>Soldier</strong> under consideration. The <strong>Soldier</strong> may include the opinion <strong>and</strong>statements of third party persons in his or her submission.e. Title required. This paragraph does not prohibit field CDRs from recommending <strong>Soldier</strong>s for removal perparagraph 4–15.4–18. Appeals of removal from a centralized promotion lista.
