L’IMPATTO DEL PACCHETTO SULLE
FONDERIE: NUOVI DIVIETI ALL’EXPORT DI
PRODOTTI DI INTERESSE
Per quanto riguarda le restrizioni all’export, l’art.
3 duodecies del Regolamento sanzionatorio già
prevedeva il divieto di fornitura ed export in Russia
dei beni elencati in Allegato XXIII. Ai prodotti
già sanzionati si aggiungono ora numerosi prodotti
di potenziale interesse per le fonderie, elencati
in Allegato XXIII bis e in Allegato XXIII ter.

FONDERIE: LA “NO RUSSIA CLAUSE”
Infine, l’applicazione concreta del c.d. “No Russia
clause” è prevista nel nuovo art. 12 octies del Regolamento
sanzionatorio.
All’atto della vendita o export in un Paese terzo
(con esclusione dei Paesi “alleati” di cui in Allegato
VIII: USA, Giappone, Regno Unito, Svizzera,
Corea del Sud, Australia, Canada, Nuova Zelanda
e Norvegia), di beni o tecnologie elencati
negli Allegati XI, XX e XXXV del Regolamento
sanzionatorio, a decorrere dal 20 marzo 2024
l’esportatore è tenuto a vietare per contratto la
riesportazione in Russia e la riesportazione per
un uso in Russia dei suddetti articoli, fra cui – di
potenziale interesse per le fonderie – parti specificamente
progettate per veicoli di navigazione
aerea o spaziale ricompresi nel Capitolo 88. •

FOUNDRIES: NEW EXPORT BANS ON
PRODUCTS OF INTEREST
Regarding export restrictions, art. 3 duodecies
of the Sanction Regulation already provided
for the ban on the supply and export to Russia
of the goods listed in Annex XXIII. Numerous
products of potential interest for foundries are
now added to the products already sanctioned,
listed in Annex XXIII bis and Annex XXIII ter.

FOUNDRIES: THE “NO RUSSIA CLAUSE”
Finally, the concrete application of the socalled
“No Russia clause” is provided for in the
new art. 12 octies of the Sanction Regulation.
Upon sale or export to a third country (with the
exclusion of the “allied” countries referred to in
Annex VIII: USA, Japan, United Kingdom, Switzerland,
South Korea, Australia, Canada, New
Zealand and Norway), of goods or technologies
listed in Annexes XI, XX and XXXV of the Sanction
Regulation, to contractually prohibit, from
20 March 2024, the re-export to Russia and
the re-export for use in Russia of the aforementioned
items, including – of potential interest
to foundries – parts specifically designed
for air or space navigation vehicles covered by
Chapter 88. •
EXTRACT OF THE LIST OF GOODS OF INTEREST IN ANNEX XXIII BIS WHOSE EXPORT IS PROHIBITED
As regards the goods in Annex XXIII bis, the prohibition does NOT apply, until 20 March 2024, for the
execution of contracts concluded before 19 December 2023 or ancillary contracts necessary for the
execution of such contracts. The list includes goods identified by Tariff Heading (4 digits) or Harmonised
System (6 digits), in which case all goods included in the relevant further 8-digit CN subdivisions
are to be understood as sanctioned.
The products of interest are included in Headings 7302, 7303, 7304, 7305, 7306, 7411, 7608, 7609,
8480 and cover various areas of application both ferrous and non-ferrous alloys: pipes and fittings
of various types and uses, elements for railways, drill pipes, foundry brackets.
EXTRACT OF THE LIST OF GOODS OF INTEREST IN ANNEX XXIII TER WHOSE EXPORT IS PROHIBITED
As regards the goods in Annex XXIII bis the ban does NOT apply, until 20 June 2024, for the execution
of contracts concluded before 19 December 2023 or ancillary contracts necessary for the execution
of such contracts. The list includes goods identified by Tariff Heading (4 digits) or Harmonised System
(6 digits), in which case all goods included in the relevant further 8-digit CN subdivisions are to be
understood as sanctioned.
In this case the products are included in the following Headings: 7305, 7307 and mainly refer to pipes
and accessories (fittings, angle pipes etc.) for various uses and alloys (ferrous and non-ferrous).
