otorga la <strong>escritura</strong> pue<strong>de</strong> dar <strong>una</strong> garantía general <strong>de</strong> dominio perfecto contra cualquier<br />
tipo <strong>de</strong> reclamos (general warranty <strong>de</strong>ed 30 ) o pue<strong>de</strong> que la garantía otorgada se limite<br />
solo a los reclamos que surjan <strong>de</strong> situaciones ocurridas a partir <strong>de</strong>l momento en que el<br />
otorgante adquirió la propiedad en cuestión (special warranty <strong>de</strong>ed 31 ). Por lo general,<br />
el primer tipo <strong>de</strong> <strong>escritura</strong> se utiliza en la transferencia <strong>de</strong> resi<strong>de</strong>ncias, mientras que las<br />
special warranty <strong>de</strong>eds son más comunes en transacciones comerciales. Existe un<br />
tercer tipo, conocido como bargain and sale <strong>de</strong>ed 32 , por el que el otorgante posee el<br />
<strong>de</strong>recho <strong>de</strong> transferir la titularidad <strong>de</strong> la propiedad pero sin realizar ningún tipo <strong>de</strong><br />
garantías respecto <strong>de</strong> cargas o gravámenes que puedan afectar al inmueble. Este tipo <strong>de</strong><br />
<strong>escritura</strong> suele utilizarse en los casos en que la transmisión es hecha por funcionarios<br />
<strong>de</strong> la justicia u otras personas que poseen la propiedad como consecuencia, por<br />
ejemplo, <strong>de</strong> secuestros o embargos.<br />
La variedad <strong>de</strong> casos <strong>de</strong>muestra la necesidad <strong>de</strong> incluir notas en la traducción. Las<br />
propuestas por Mazzucco y Maranghello para las general warranty <strong>de</strong>eds y las bargain<br />
and sale <strong>de</strong>ed son buenos ejemplos <strong>de</strong> cómo explicar los conceptos (ver Mazzucco y<br />
Maranghello, 2004: 100 y 101). El caso <strong>de</strong> las special warranty <strong>de</strong>eds, sin embargo,<br />
requiere <strong>de</strong> un análisis un poco más profundo. Como dijimos anteriormente, resulta<br />
peligroso caer en generalizaciones <strong>de</strong>bido a la variedad <strong>de</strong> casos que se presentan en los<br />
distintos estados, pero cabe <strong>de</strong>stacar que mientras Mazzucco y Maranghello equiparan la<br />
special warranty <strong>de</strong>ed a la quitclaim <strong>de</strong>ed, que <strong>de</strong>finen como la “<strong>escritura</strong> traslativa <strong>de</strong><br />
dominio sobre un bien inmueble en la cual el propietario renuncia al dominio sobre el<br />
bien y en la que no manifiesta si el título es perfecto ni garantiza o avala el título <strong>de</strong><br />

conceptos jurídicos nos reveló que, en la mayoría <strong>de</strong> los estados, la quitclaim <strong>de</strong>ed no es<br />
en realidad <strong>una</strong> <strong>escritura</strong> sino un estoppel, es <strong>de</strong>cir un principio jurídico por el que se<br />
<strong>de</strong>sconocen los <strong>de</strong>rechos <strong>de</strong> <strong>una</strong> persona con respecto a <strong>una</strong> propiedad. Sin entrar en<br />
<strong>de</strong>talles, ya nos es posible percibir diferencias entre la <strong>de</strong>finición <strong>de</strong> Mazzucco y<br />
