2. Nothing in paragraph 1 <strong>of</strong> this article shall be interpreted as limiting the circumstances<br />
in which there is no consent.<br />
3. Term ‘’Sexual act’’ means penetration however slight <strong>of</strong> any part <strong>of</strong> the body <strong>of</strong> a<br />
person with a sexual organ, or the penetration however slight <strong>of</strong> the anal or genital<br />
opening <strong>of</strong> a person with any object or any other part <strong>of</strong> the body.<br />
4. Term ‘’Subjecting another person to a sexual act’’ means the commission <strong>of</strong> a sexual<br />
act on another person by the perpetrator, or inducing another person to commit a sexual<br />
act on the perpetrator or a third person or inducing a third person to commit a sexual act<br />
on another person.<br />
5. Term ‘’Private parts’’ means the breasts <strong>of</strong> a woman, the penis, vagina and/or anus.<br />
6. Term ‘’Touching’’ means any direct or indirect contact, where there is no penetration,<br />
between the body <strong>of</strong> a person with any part <strong>of</strong> the body <strong>of</strong> another person or with an<br />
object.<br />
7. Term ‘’Child pornography’’ means any visual image or visual depiction or<br />
representation, including any photograph, film, video, picture or computer generated<br />
image or picture, whether made or produced by electronic, mechanical or other means,<br />
which shows or represents:<br />
7.1. the genitals (vagina, penis or anus) or the pubic area <strong>of</strong> a child primarily for<br />
sexual purposes;<br />
7.2. a real child engaged in actual or simulated sexually explicit conduct;<br />
7.3. a person appearing to be a real child engaged in actual or simulated sexually<br />
explicit conduct; or<br />
7.4. realistic images <strong>of</strong> a non-existent child engaged in actual or simulated<br />
sexually explicit conduct.<br />
8. Term ‘’Prostitution’’ means <strong>of</strong>fering or providing sexual services in exchange for<br />
payment, goods or services including, but not limited to, the discharge <strong>of</strong> an obligation to<br />
pay or the provision <strong>of</strong> goods or services including sexual services gratuitously or at a<br />
discount. It is irrelevant whether the payment, goods or services are given or promised to<br />
the person engaging in the sexual services or to a third person.<br />
