2. Whoever, by the use <strong>of</strong> a noxious or harmful substance, pollutes any body <strong>of</strong> water and<br />
thereby endangers the survival <strong>of</strong> animals, birds, bees, wild animals or fish in the water<br />
shall be punished as provided for in paragraph 1 <strong>of</strong> this Article.<br />
3. When the <strong>of</strong>fense provided for in paragraph 1 or 2 <strong>of</strong> this Article results in the death <strong>of</strong><br />
a large number <strong>of</strong> animals, birds, bees, wild animals or fish <strong>of</strong> a value exceeding ten<br />
thousand (10,000) EUR, the perpetrator shall be punished by a fine and imprisonment <strong>of</strong><br />
three (3) months to three (3) years.<br />
4. When the <strong>of</strong>fense provided for in paragraph 1 or 2 <strong>of</strong> this Article is committed by<br />
negligence, the perpetrator shall be punished by a fine or imprisonment up to three (3)<br />
months. When the <strong>of</strong>fense provided for in paragraph 3 <strong>of</strong> this Article is committed by<br />
negligence, the perpetrator shall be punished by a fine or imprisonment <strong>of</strong> up to six (6)<br />
months.<br />
Article 356<br />
Destruction <strong>of</strong> vegetation by harmful substances<br />
1. Whoever, contrary to the law and by the use <strong>of</strong> a harmful substance, causes the<br />
destruction <strong>of</strong>, plants, trees or other vegetation and thereby causes damage <strong>of</strong> ten<br />
thousand (10,000) EUR or more shall be punished by a fine or by imprisonment <strong>of</strong> up to<br />
two (2) years.<br />
2. If the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article is committed against a<br />
specially protected, plants, trees or vegetation, the perpetrator shall be punished by a fine<br />
or by imprisonment from three (3) months to three (3) years.<br />
3. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article is committed by<br />
negligence, the perpetrator shall be punished by a fine or imprisonment <strong>of</strong> up to six (6)<br />
months. When the <strong>of</strong>fense provided for in paragraph 2 <strong>of</strong> this Article is committed by<br />
negligence, the perpetrator shall be punished by a fine or by imprisonment <strong>of</strong> up to one<br />
(1) year.<br />
Article 357<br />
Devastation <strong>of</strong> forests<br />
1. Whoever, in violation <strong>of</strong> the law or an order by a competent authority, cuts or destroys<br />
a forest or in any other way devastates forests shall be punished by a fine or by<br />
imprisonment <strong>of</strong> up to two (2) years.<br />
2. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article is committed in a<br />
protected forest, protected park or any other forest used for a specific purpose the<br />
perpetrator shall be punished by a fine or by imprisonment <strong>of</strong> up to three (3) years.<br />
