authority, for any reason when this is considered necessary to ensure the proper<br />
administration <strong>of</strong> justice, to assign EULEX judges to the respective stage <strong>of</strong> a criminal<br />
proceeding, according to the modalities on case selection and case allocation developed<br />
by the Assembly <strong>of</strong> the EULEX Judges and in compliance with the Law on the<br />
Jurisdiction, Case selection and Case Allocation <strong>of</strong> EULEX Judges and Prosecutors in<br />
<strong>Kosovo</strong>, in addition to the crimes foreseen in Article 3.3 <strong>of</strong> the Law on the Jurisdiction,<br />
Case selection and Case Allocation <strong>of</strong> EULEX Judges and Prosecutors in <strong>Kosovo</strong> for the<br />
following crimes when the investigation or prosecution is not conducted by the Special<br />
Prosecution Office <strong>of</strong> the Republic <strong>of</strong> <strong>Kosovo</strong>:<br />
2.1. assault on the Constitutional Order <strong>of</strong> the Republic <strong>of</strong> <strong>Kosovo</strong> as set forth in<br />
paragraph 1 <strong>of</strong> Article 121 <strong>of</strong> this <strong>Code</strong>;<br />
2.2. inciting National, Racial, Religious or Ethnic Hatred, Discord or Intolerance<br />
as set forth in Article 147 <strong>of</strong> this <strong>Code</strong>;<br />
2.3.hijacking Aircraft, Endangering Civil Aviation Safety, Endangering Maritime<br />
Navigation Safety, Endangering the Safety <strong>of</strong> Fixed Platforms located on the<br />
Continental Shelf and Piracy as set forth in Articles 164-168 <strong>of</strong> this <strong>Code</strong>;<br />
2.4. smuggling <strong>of</strong> Migrants as set forth in Article 170 <strong>of</strong> this <strong>Code</strong>;<br />
2.5. trafficking in Persons as set forth in Article 171 <strong>of</strong> this <strong>Code</strong>;<br />
2.6. sexual services <strong>of</strong> Victims <strong>of</strong> Trafficking as set forth in Article 231 <strong>of</strong> this<br />
<strong>Code</strong>;<br />
2.7. inducing Sexual Acts by False Promise <strong>of</strong> Marriage as set forth in Article 240<br />
<strong>of</strong> this <strong>Code</strong>;<br />
2.8. providing Premises for Prostitution as set forth in Article 242 <strong>of</strong> this <strong>Code</strong>;<br />
2.9. unlawful Transplantation and Trafficking <strong>of</strong> Human Organs and Tissues as<br />
set forth in Article 265 <strong>of</strong> this <strong>Code</strong>;<br />
2.10. endangering United Nations and Associated Personnel as set forth in Article<br />
174 <strong>of</strong> this <strong>Code</strong>;<br />
2.11. murder and Aggravated Murder as set forth in Articles178 and 179 <strong>of</strong> this<br />
<strong>Code</strong>;<br />
2.12. hostage Taking and Kidnapping as set forth in Articles 175 and 194 <strong>of</strong> this<br />
<strong>Code</strong>;<br />
2.13. violating Equal Status <strong>of</strong> Citizens and Residents <strong>of</strong> <strong>Kosovo</strong> as set forth in<br />
Article 193 <strong>of</strong> this <strong>Code</strong>;<br />
