4. When the perpetrator <strong>of</strong> the <strong>of</strong>fense provided for in paragraph 1 or 2 <strong>of</strong> this Article<br />
withdraws voluntarily from the uprising before exercising force or serious threat, the<br />
court may waive his punishment.<br />
Article 405<br />
Escape <strong>of</strong> persons deprived <strong>of</strong> liberty<br />
1. Whoever, escapes from the institution where he or she is detained on the basis <strong>of</strong> a<br />
lawful decision ordering the deprivation <strong>of</strong> liberty, shall be punished by imprisonment <strong>of</strong><br />
up to three (3) years.<br />
2. Whoever, by the use <strong>of</strong> bribery, escapes from the institution where he or she is<br />
detained on the basis <strong>of</strong> a lawful decision ordering the deprivation <strong>of</strong> liberty shall be<br />
punished by imprisonment <strong>of</strong> up to five (5) years.<br />
3. Whoever, by the use <strong>of</strong> force or serious threat, escapes from the institution where he<br />
or she is detained on the basis <strong>of</strong> a lawful decision ordering the deprivation <strong>of</strong> liberty,<br />
shall be punished by imprisonment <strong>of</strong> one (1) to five (5) years.<br />
Article 406<br />
Facilitating the escape <strong>of</strong> persons deprived <strong>of</strong> liberty<br />
1. Whoever facilitates the escape <strong>of</strong> a person who is detained on the basis <strong>of</strong> a lawful<br />
decision ordering the deprivation <strong>of</strong> liberty, shall be punished by imprisonment <strong>of</strong> three<br />
(3) months to five (5) years.<br />
2. Whoever, by the use <strong>of</strong> bribery facilitates the escape <strong>of</strong> a person who is detained on<br />
the basis <strong>of</strong> a lawful decision ordering the deprivation <strong>of</strong> liberty, shall be punished by<br />
imprisonment <strong>of</strong> three (3) months to five (5) years.<br />
3. Whoever, by use <strong>of</strong> force or serious threat, facilitates the escape <strong>of</strong> a person who is<br />
detained on the basis <strong>of</strong> a lawful decision ordering the deprivation <strong>of</strong> liberty, shall be<br />
punished by imprisonment <strong>of</strong> three (3) months to five (5) years.<br />
4. When the <strong>of</strong>fense provided for in this Article is committed jointly by more than one<br />
person, they shall be punished by imprisonment <strong>of</strong> one (1) to eight (8) years.<br />
Article 407<br />
Unlawful release <strong>of</strong> persons deprived <strong>of</strong> liberty<br />
An <strong>of</strong>ficial person who in abusing his or her position or authorizations, unlawfully<br />
releases another person deprived <strong>of</strong> liberty and entrusted to him or her, aids his or her<br />
escape or enables an unlawful connection or correspondence whose purpose is the<br />
