has a unique value or if the <strong>of</strong>fense results in serious damage, the perpetrator shall be<br />

punished by a fine or by imprisonment <strong>of</strong> up to three (3) years.<br />

3. Whoever, without proper authorization by a competent authority, removes from the<br />

Republic <strong>of</strong> <strong>Kosovo</strong> a protected cultural, historical, religious, scientific or natural<br />

monument or object shall be punished by a fine or by imprisonment <strong>of</strong> up to one (1) year.<br />

4. When the <strong>of</strong>fense provided for in paragraph 3 <strong>of</strong> this Article involves a protected<br />

cultural, historical, religious, scientific or natural monument or an object that has a<br />

unique value, the perpetrator shall be punished by a fine or by imprisonment <strong>of</strong> up to<br />

three (3) years.<br />

5. For the purposes <strong>of</strong> this Article, a “protected cultural, historical, religious, scientific or<br />

natural monument or object” means an object <strong>of</strong> veneration <strong>of</strong> a religious community<br />

existing on property dedicated to religious services, a tombstone, grave or some other<br />

place <strong>of</strong> burial, and a public monument, a natural monument, an object <strong>of</strong> art, science or<br />

craft which is kept in a public collection or public exhibition, an object which serves a<br />

public need or decorates a public road, square or park, a natural curiosity or an<br />

endangered type <strong>of</strong> animal or plant.<br />

6. An attempt to commit the <strong>of</strong>fense provided for in paragraph 1 or 3 <strong>of</strong> this Article shall<br />

be punishable.<br />

Article 364<br />

Unauthorized work and appropriation <strong>of</strong> cultural monuments<br />

1. Whoever, without authorization by the competent authority, conducts conservation,<br />

restoration or research work on a cultural monument, or, despite a prohibition or without<br />

the authorization, carries out archaeological excavations or research and thereby destroys<br />

or seriously damages a cultural monument or its characteristics shall be punished by a<br />

fine or by imprisonment <strong>of</strong> up to two (2) years.<br />

2. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article is committed against a<br />

cultural monument <strong>of</strong> unique value or results in serious damage, the perpetrator shall be<br />

punished by a fine and by imprisonment <strong>of</strong> six (6) months to three (3) years.<br />

3. Whoever, in the course <strong>of</strong> archaeological or other research, takes possession <strong>of</strong> or takes<br />

away an object which has been excavated or an object which has been found in some<br />

other way and which represents a cultural monument shall be punished as provided for in<br />

paragraph 2 <strong>of</strong> this Article.<br />
