2. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article results in a material<br />
benefit exceeding tent thousand (10,000) EUR, or material damage exceeding ten<br />
thousand (10,000) EUR, the perpetrator shall be punished by a fine and imprisonment <strong>of</strong><br />
six (6) months to five (5) years.<br />
Article 340<br />
Extortion<br />
1. Whoever, with the intent to obtain an unlawful material benefit for himself, herself or<br />
another person, uses force or serious threat to compel another person to do or abstain<br />
from doing an act to the detriment <strong>of</strong> his or her property or another person’s property<br />
shall be punished by a fine and imprisonment <strong>of</strong> three (3) months to five (5) years.<br />
2. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article is committed by a<br />
perpetrator acting as a member <strong>of</strong> a group, is committed using a weapon or a dangerous<br />
instrument; or, the <strong>of</strong>fense results in a material benefit in a sum that exceeds ten thousand<br />
(10,000) EUR, the perpetrator shall be punished by a fine and imprisonment <strong>of</strong> one (1) to<br />
ten (10) years.<br />
Article 341<br />
Blackmail<br />
1. Whoever, with the intent <strong>of</strong> obtaining an unlawful material benefit for himself, herself<br />
or another person, threatens another person to reveal something about him or her or about<br />
persons close to him or her which will damage their honor or reputation, and in this way<br />
compels such person to do or abstain from doing an act to the detriment <strong>of</strong> his or her<br />
property or another person’s property shall be punished by a fine and imprisonment <strong>of</strong> six<br />
(6) months to five (5) years.<br />
2. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article is committed by a<br />
perpetrator acting as a member <strong>of</strong> a group; is committed using a weapon or a dangerous<br />
instrument; or, the <strong>of</strong>fense results in an unlawful material gain exceeding ten thousand<br />
(10,000) EUR, the perpetrator shall be punished by a fine and imprisonment <strong>of</strong> one (1) to<br />
ten (10) years.<br />
Article 342<br />
Breach <strong>of</strong> trust<br />
1. Whoever, in representing, maintaining or taking care <strong>of</strong> the property interests <strong>of</strong><br />
another person fails to perform his or her duty or misuses his or her authorizations with<br />
the intent <strong>of</strong> obtaining an unlawful material benefit for himself, herself or another person<br />
or to cause damage to the person whose property interests he or she is representing or<br />
