5. If the <strong>of</strong>fense from paragraph 1-4 <strong>of</strong> this Article results in death <strong>of</strong> one or more<br />
persons, the perpetrator shall be punished by imprisonment <strong>of</strong> not less than ten (10) years<br />
or life long imprisonment.<br />
6. For the purposes <strong>of</strong> this Article and Article 172 <strong>of</strong> this <strong>Code</strong> expressions below shall<br />
have the following meaning:<br />
6.1. Trafficking in persons - the recruitment, transportation, transfer, harboring<br />
or receipt <strong>of</strong> persons, by threat or the use <strong>of</strong> force or other forms <strong>of</strong> coercion,<br />
abduction, fraud, deception, the abuse <strong>of</strong> power or the abuse <strong>of</strong> a position <strong>of</strong><br />
vulnerability or the giving or receiving <strong>of</strong> payments or benefits to achieve the<br />
consent <strong>of</strong> a person having control over another person, for the purpose <strong>of</strong><br />
exploitation.<br />
6.2. Exploitation - as used in sub-paragraph 6.1 <strong>of</strong> this paragraph shall include,<br />
but not be limited to, prostitution <strong>of</strong> others, pornography or other forms <strong>of</strong> sexual<br />
exploitation, begging, forced or compulsory labour or services, slavery or<br />
practices similar to slavery, servitude or the removal <strong>of</strong> organs or tissue.<br />
6.3. The consent <strong>of</strong> a victim <strong>of</strong> trafficking in persons to the intended exploitation<br />
shall be irrelevant where any <strong>of</strong> the means set forth in sub-paragraph 6.1. <strong>of</strong> this<br />
paragraph have been used against such victim.<br />
6.4. The recruitment, transportation, transfer, harboring or receipt <strong>of</strong> a child for<br />
the purpose <strong>of</strong> exploitation shall be considered “trafficking in persons” even if<br />
this does not involve any <strong>of</strong> the means set forth in subparagraph 6.1. <strong>of</strong> this<br />
paragraph.<br />
Article 172<br />
Withholding identity papers <strong>of</strong> victims <strong>of</strong> slavery or trafficking in persons<br />
1. Whoever withholds another person’s personal identification documents or passport<br />
knowing that the person is a victim <strong>of</strong> a criminal <strong>of</strong>fenses provided for in Articles 169<br />
and 171, shall be punished by imprisonment <strong>of</strong> one (1) to five (5) years.<br />
2. When the <strong>of</strong>fense provided for in paragraph 1. <strong>of</strong> this Article is committed by an<br />
<strong>of</strong>ficial person abusing his or her position or authorizations, the perpetrator shall be<br />
punished by imprisonment <strong>of</strong> three (3) to seven (7) years.<br />
