2.26. conscripting or enlisting children under the age of fifteen (15) years into the
national armed forces or using them to participate actively in hostilities;
2.27. intentionally launching an attack against works or installations containing
dangerous forces in the knowledge that such attack will cause excessive loss of
life, injury to civilians or damage to civilian objects;
2.28. intentionally launching an indiscriminate attack where such attack is not
directed at a specific military objective, employs a method or means of combat
which cannot be directed at a specific military objective or employs a method or
means of combat the effects of which cannot be limited as required by Protocol I
Additional to the Geneva Convention of 12 August 1949 and consequently, is of a
nature to strike military objectives and civilians or civilian objects without
distinction;
2.29. enslavement and slave trade;
2.30. imposing collective punishments;
2.31. pressuring the population of an occupied territory to change their nationality
or to take an oath to an enemy power.
Article 152
War crimes in serious violation of Article 3 common to the Geneva conventions
1. Whoever commits a serious violation of Article 3 common to the four Geneva
Conventions of 12 August 1949 shall be punished by imprisonment of not less than five
(5) years or by life long imprisonment.
2. A serious violation of Article 3 common to the four Geneva Conventions of 12 August
1949 means one or more of the following acts committed in the context of an armed
conflict not of an international character against persons taking no active part in the
hostilities, including members of armed forces who have laid down their arms and those
placed hors de combat by sickness, wounds, detention or any other cause:
2.1. violence to life and person, in particular murder of all kinds, mutilation, cruel
treatment and torture;
2.2. committing outrages upon personal dignity, in particular humiliating and
degrading treatment;
2.3. taking of hostages;
