importance; is part <strong>of</strong> a public collection, a protected private collection or a public<br />
exhibition; is a natural monument or, object <strong>of</strong> nature under protection; is exposed in<br />
public or is an item that serves for public use or for decoration <strong>of</strong> a square, street or park,<br />
the perpetrator shall be punished by a fine and by imprisonment up to three (3) years<br />
without regard to the loss.<br />
4. When the criminal <strong>of</strong>fence provided for in paragraph 1 <strong>of</strong> this Article is committed<br />
because <strong>of</strong> bias towards nationality, language, religious belief or lack <strong>of</strong> religious belief,<br />
color <strong>of</strong> skin, gender, sexual orientation, or because <strong>of</strong> their affinity with persons who<br />
have one the aforementioned protected characteristics, the perpetrator <strong>of</strong> the criminal<br />
<strong>of</strong>fence shall be punished by imprisonment <strong>of</strong> up to three (3) years.<br />
Article 334<br />
Arson<br />
1. Whoever starts a fire or causes an explosion with the purpose <strong>of</strong> damaging or<br />
destroying the property <strong>of</strong> another person shall be punished by imprisonment <strong>of</strong> six (6)<br />
months to three (3) years.<br />
2. Whoever starts a fire or causes an explosion with the purpose <strong>of</strong> destroying another<br />
person’s building or vehicle and the building or vehicle is occupied or in use shall be<br />
punished by imprisonment <strong>of</strong> one (1) to five (5) years.<br />
3. When the <strong>of</strong>fense in paragraph 1 or 2 <strong>of</strong> this Article involves damage <strong>of</strong> twenty<br />
thousand (20,000) EUR or more to the property, or the <strong>of</strong>fense causes grievous bodily<br />
injury to another, the perpetrator shall be punished by imprisonment <strong>of</strong> three (3) to ten<br />
(10) years.<br />
4. If the criminal <strong>of</strong>fense from paragraph 1 or 2 <strong>of</strong> this Article results in death, the<br />
perpetrator shall be punished by not less than ten (10) years or lifelong imprisonment.<br />
Article 335<br />
Fraud<br />
1. Except as provided for in Article 336 <strong>of</strong> this <strong>Code</strong>, whoever, by means <strong>of</strong> a false<br />
representation <strong>of</strong> facts or by concealing facts and with the intent to obtain an unlawful<br />
material benefit for himself, herself or another person, or to cause material damage to<br />
another person, deceives or continues the deception <strong>of</strong> another person and thereby<br />
induces a person to do or abstain from doing an act to the detriment <strong>of</strong> his or her property<br />
or another person’s property shall be punished by a fine and imprisonment <strong>of</strong> three (3)<br />
months to three (3) years.<br />
