gain, or compels such child to engage in other activities that endanger or damage the<br />

child’s development shall be punished by a fine and imprisonment <strong>of</strong> one (1) to five (5)<br />

years.<br />

5. When an <strong>of</strong>fense provided for in this Article results in grievous bodily injury or<br />

grievous damage to the mental health <strong>of</strong> a child, the perpetrator shall be punished by<br />

imprisonment <strong>of</strong> two (2) to eight (8) years.<br />

Article 251<br />

Violating family obligations<br />

1. Whoever violates his or her legal family obligations leaving a family member who is<br />

incapable taking care <strong>of</strong> himself or herself shall be punished by imprisonment <strong>of</strong> three (3)<br />

months to three (3) years.<br />

2. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article involves a child, the<br />

perpetrator shall be punished by imprisonment <strong>of</strong> six (6) months to five (5) years<br />

3. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article results in the death <strong>of</strong> the<br />

family member or serious impairment to his or her health, the perpetrator shall be<br />

punished by imprisonment <strong>of</strong> one (1) to eight (8) years.<br />

4. If the court imposes a suspended sentence, it may order, as a condition, that the<br />

perpetrator pay and regularly fulfill his or her obligations <strong>of</strong> care, education and<br />

maintenance support.<br />

Article 252<br />

Avoiding maintenance support<br />

1. Whoever fails to provide maintenance support to a person whom he or she is obliged to<br />

support based on a decision <strong>of</strong> the court which has entered into force, a settlement<br />

concluded before the court which has entered into force or a decision by another<br />

competent authority by avoiding employment, falsely reporting employment or income,<br />

changing jobs, place <strong>of</strong> residence or abode, alienating property or otherwise failing to<br />

provide subsistence support to such person shall be punished by imprisonment <strong>of</strong> up to<br />

one (1) year.<br />

2. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article results in the death <strong>of</strong> the<br />

family member or serious impairment to his or her health, the perpetrator shall be<br />

punished by imprisonment <strong>of</strong> one (1) to eight (8) years.<br />

3. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article involves a child, the<br />

perpetrator shall be punished by imprisonment <strong>of</strong> three (3) months to three (3) years.<br />
