7. The counterfeit securities, payment instruments and the equipment for their<br />

manufacturing or alteration shall be confiscated.<br />

8. ‘Payment instrument’ shall mean a corporeal instrument, other than money enabling by<br />

its specific nature, alone or in conjunction with another payment instrument, the holder or<br />

user to transfer money or monetary value. This would include but not be limited to stock<br />

shares, share certificates, bonds, credit cards, eurocheque cards, other cards issued by<br />

financial institutions, travelers’ cherubs, eurocheques, other traveler’s cheques and bills<br />

<strong>of</strong> exchange, which are protected against imitation or fraudulent use, through design,<br />

coding, signature or other means.<br />

9. Counterfeit securities or payment instruments includes falsified securities or payment<br />

instruments and genuine securities or payment instruments that have been altered in<br />

material respect and with the intent to use them for fraudulent purposes.<br />

Article 294<br />

Counterfeiting stamps <strong>of</strong> value<br />

1. Whoever produces counterfeit stamps <strong>of</strong> value, alters any <strong>of</strong> these stamps with the<br />

intent to use them as genuine, gives to another person to use or uses such counterfeit<br />

stamps as genuine, shall be punished by fine or by imprisonment <strong>of</strong> up to three (3) years.<br />

2. Whoever, with the knowledge that a stamp <strong>of</strong> value is counterfeit, supplies, sells,<br />

purchases, distributes, transports, receives or possesses a counterfeit or canceled stamp<br />

with the intent to distribute or use it as genuine, shall be punished by imprisonment <strong>of</strong> up<br />

to three (3) years.<br />

3. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article involves stamps <strong>of</strong> a value<br />

exceeding ten thousand (10,000) EUR, the perpetrator shall be punished by a fine and<br />

imprisonment <strong>of</strong> six (6) months up to five (5) years.<br />

4. Whoever removes a canceling stamp from a stamp <strong>of</strong> value referred to in paragraph 1<br />

this Article, or in some other way and for the purpose <strong>of</strong> repeated use, attempts to make<br />

such stamp appear as if it has never been used before, or reuses a used stamp or sells it as<br />

valid, shall be punished by a fine or imprisonment up to one (1) year.<br />

5. Whoever has received the counterfeit stamp <strong>of</strong> value as genuine and uses it with<br />

knowledge that it is counterfeit, shall be punished by a fine or by imprisonment <strong>of</strong> up to<br />

one (1) year.<br />

6. Whoever has knowledge <strong>of</strong> a counterfeit stamp <strong>of</strong> value being made or used, and fails<br />

to report it shall be punished by a fine or by imprisonment <strong>of</strong> up to one (1) year.<br />

7. Counterfeit stamps <strong>of</strong> value and the equipment for their manufacturing or alteration<br />

shall be confiscated.<br />
