GENERAL PROVISIONS<br />
Article 1<br />
Basis and limits <strong>of</strong> criminal sanctions<br />
1. <strong>Criminal</strong> <strong>of</strong>fenses and criminal sanctions are foreseen only for those actions that<br />
infringe and violate the freedoms, human rights and other rights and social values<br />
guaranteed and protected by the Constitution <strong>of</strong> the Republic <strong>of</strong> <strong>Kosovo</strong> and international<br />
law to the extent that is not possible to protect these values without criminal sanctions.<br />
2. The criminal <strong>of</strong>fenses and the types <strong>of</strong> measures and the severity <strong>of</strong> the criminal<br />
sanctions for the perpetrators <strong>of</strong> criminal <strong>of</strong>fenses are based on the necessity <strong>of</strong> criminal<br />
justice enforcement and the proportionality <strong>of</strong> the level and nature <strong>of</strong> the danger for<br />
human rights and freedoms and social values.<br />
