4. The provisions <strong>of</strong> this Article shall apply to a person who discloses an <strong>of</strong>ficial secret<br />
after his or her <strong>of</strong>ficial status has ceased.<br />
5. For the purposes <strong>of</strong> this Article, the term “<strong>of</strong>ficial secret” means information or<br />
documents proclaimed by law, other provisions, or by a decision by the competent<br />
authority issued on the basis <strong>of</strong> law to be an <strong>of</strong>ficial secret and whose disclosure has<br />
caused or might cause detrimental consequences. However, the following are not <strong>of</strong>ficial<br />
secrets:<br />
5.1. information or documents that pertain to grave violations <strong>of</strong> basic human<br />
rights or which the failure to disclose could endanger the constitutional order or<br />
security <strong>of</strong> the Republic <strong>of</strong> <strong>Kosovo</strong>; or,<br />
5.2. information and documents that are intended to conceal the perpetrator <strong>of</strong> a<br />
criminal <strong>of</strong>fense punishable by imprisonment <strong>of</strong> at least five (5) years.<br />
Article 434<br />
Falsifying <strong>of</strong>ficial document<br />
1. An <strong>of</strong>ficial person who, in an <strong>of</strong>ficial document, <strong>of</strong>ficial register or file, enters false<br />
information or fails to enter essential information or with his or her signature or <strong>of</strong>ficial<br />
stamp certifies a document, <strong>of</strong>ficial register or file which contains false data or enables<br />
the compilation <strong>of</strong> such document, register or file with false contents shall be punished by<br />
imprisonment <strong>of</strong> six (6) months to five (5) years.<br />
2. An <strong>of</strong>ficial person who uses a false document, <strong>of</strong>ficial register or file as if it were true<br />
in his or her duty or business activity or who destroys, hides, damages or in any other<br />
way renders unusable the document, <strong>of</strong>ficial register or file shall be punished as provided<br />
for in paragraph 1 <strong>of</strong> this Article.<br />
Article 435<br />
Unlawful collection and disbursement<br />
1. An <strong>of</strong>ficial person who collects from another something that such person is not bound<br />
to pay or collects more than such person is bound to pay or who, in a payment or delivery<br />
pays or delivers less than what is required shall be punished by a fine or by imprisonment<br />
<strong>of</strong> up to one (1) year.<br />
2. If the value <strong>of</strong> the payments or delivery, provided for in paragraph 1 <strong>of</strong> this Article,<br />
exceeds fifteen thousand (15,000) EUR, the perpetrator shall be punishment buy<br />
imprisonment up to three (3) years.<br />
3. An attempt to commit the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article shall be<br />
punishable.<br />
