Article 257<br />
Transmitting venereal diseases<br />
1. Whoever, knowing that he or she is infected with a sexually transmitted disease, fails<br />
to disclose this fact and infects another person, shall be punished by a fine or by<br />
imprisonment <strong>of</strong> up to one (1) year.<br />
2. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article results in the serious<br />
impairment to another’s health, the perpetrator shall be punished by imprisonment <strong>of</strong> one<br />
(1) to five (5) years.<br />
3. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article results in the death <strong>of</strong> a<br />
person, the perpetrator shall be punished by imprisonment <strong>of</strong> one (1) to eight (8) years.<br />
4. <strong>Criminal</strong> proceedings for the <strong>of</strong>fense provided for in this Article shall be initiated by a<br />
motion.<br />
Article 258<br />
Spreading the HIV virus<br />
1. Whoever, knowing that he or she is infected with HIV, fails to disclose this fact and<br />
infects another person, shall be punished by imprisonment <strong>of</strong> two (2) to twelve (12)<br />
years.<br />
2. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article is committed by<br />
negligence, the perpetrator shall be punished by imprisonment <strong>of</strong> six (6) months to five<br />
(5) years.<br />
3. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article results in the death <strong>of</strong> a<br />
person, the perpetrator shall be punished by imprisonment <strong>of</strong> five (5) to fifteen (15) years.<br />
4. When the <strong>of</strong>fense provided for in paragraph 2 <strong>of</strong> this Article results in the death <strong>of</strong> a<br />
person, the perpetrator shall be punished by imprisonment <strong>of</strong> one (1) to eight (8) years.<br />
Article 259<br />
Employing persons infected by contagious diseases<br />
1. Whoever, contrary to health laws, in a hospital, maternity hospital, school, restaurant, a<br />
store where food items are processed or hygienic services are carried out or in a similar<br />
business organization or workplace, employs or continues to employ a person whom he<br />
or she knows to be suffering from a contagious disease and thereby causes the<br />
transmission <strong>of</strong> the contagious disease shall be punished by a fine or by imprisonment <strong>of</strong><br />
up to one (1) year.<br />
