punished by a fine and imprisonment <strong>of</strong> six (6) months to five (5) years.<br />
2. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article results in a material<br />
benefit exceeding five thousand (5,000) EUR, the perpetrator shall be punished by a fine<br />
and imprisonment <strong>of</strong> one (1) to eight (8) years.<br />
3. When the <strong>of</strong>fense provided for in paragraph 1 <strong>of</strong> this Article results in a material<br />
benefit exceeding fifty thousand (50,000) EUR, the perpetrator shall be punished by a<br />
fine and imprisonment <strong>of</strong> three (3) to twelve (12) years.<br />
Article 427<br />
Unauthorised use <strong>of</strong> property<br />
Whoever, without authorization, uses money, securities or other movable property which<br />
has been entrusted to him or her in his or her duty or generally in his or her workplace or<br />
which has been made accessible to him or her because <strong>of</strong> his or her service or work or<br />
whoever confers such property on another person for unauthorized use shall be punished<br />
by a fine or by imprisonment <strong>of</strong> up to three (3) years.<br />
Article 428<br />
Accepting bribes<br />
1. An <strong>of</strong>ficial person who requests or receives, directly or indirectly, any undue gift or<br />
advantage, for himself, herself or for another person, or who accepts an <strong>of</strong>fer or promise<br />
<strong>of</strong> such gift or advantage, so that the <strong>of</strong>ficial person acts or refrains from acting in<br />
accordance with his or her <strong>of</strong>ficial duties, shall be punished by fine and imprisonment <strong>of</strong><br />
six (6) months to five (5) years.<br />
2. An <strong>of</strong>ficial person who requests or receives, directly or indirectly, any undue gift or<br />
advantage, for himself or herself or for another person, or accepts an <strong>of</strong>fer or promise <strong>of</strong><br />
such gift or advantage, so that the <strong>of</strong>ficial person acts or refrains from acting, in violation<br />
<strong>of</strong> his or her <strong>of</strong>ficial duties, shall be punished by fine and imprisonment <strong>of</strong> three (3) to<br />
twelve (12) years.<br />
3. When the <strong>of</strong>fense under paragraph 1 <strong>of</strong> this Article results in a benefit exceeding<br />
fifteen thousand (15,000) EUR, the perpetrator shall be punished by fine and<br />
imprisonment <strong>of</strong> one (1) to eight (8) years.<br />
