4. Whoever without authorization or in contravention <strong>of</strong> applicable law with the purpose<br />

for transplantation takes body parts <strong>of</strong> a deceased person shall be punished by a fine or by<br />

imprisonment <strong>of</strong> up to three (3) years.<br />

5. Whoever, without authorization or in contravention <strong>of</strong> applicable law, possesses,<br />

purchases, solicits for purchase, sells, transports, imports or exports a human organ or<br />

tissue for purposes <strong>of</strong> transplantation shall be punished by a fine and imprisonment <strong>of</strong><br />

two (2) to twelve (12) years.<br />

6. Whoever for a reward or other gain acts as an intermediary to obtain a body or body<br />

parts <strong>of</strong> another living or deceased person with the purpose <strong>of</strong> transplantation, shall be<br />

punished by a fine or by imprisonment <strong>of</strong> six (6) months up to two (2) years.<br />

7. If the <strong>of</strong>fense provided for in paragraphs 1 or 2 <strong>of</strong> this Article is committed by a<br />

physician, the perpetrator shall be punished by imprisonment <strong>of</strong> one (1) to eight (8) years.<br />

8. If the <strong>of</strong>fense provided for in paragraph 3 <strong>of</strong> this Article is committed by a physician,<br />

the perpetrator shall be punished by imprisonment <strong>of</strong> three (3) to twelve (12) years.<br />

Article 266<br />

Production and distribution <strong>of</strong> tainted medical products<br />

1. Whoever produces counterfeit or tainted drugs or other medical products which are<br />

harmful to health with the purpose <strong>of</strong> selling them or otherwise putting them into<br />

circulation shall be punished by a fine and imprisonment <strong>of</strong> up to three (3) years.<br />

2. Whoever puts into circulation drugs or medical products without undertaking the<br />

necessary control by an authorized person or entity, or circulates the items after their<br />

expiry date, shall be punished by imprisonment <strong>of</strong> up to three (3) years.<br />

3. When the <strong>of</strong>fense provided for in paragraph 1 or 2 <strong>of</strong> this Article is committed by<br />

negligence, the perpetrator shall be punished by a fine and imprisonment <strong>of</strong> up to two (2)<br />

years.<br />

4. When the <strong>of</strong>fense provided for in paragraph 1 or 2 <strong>of</strong> this Article results in grievous<br />

bodily injury or serious impairment to health, the perpetrator shall be punished by<br />

imprisonment <strong>of</strong> one (1) to eight (8) years.<br />

5. When the <strong>of</strong>fense provided for in paragraph 3 <strong>of</strong> this Article results in grievous bodily<br />

injury or serious impairment to health, the perpetrator shall be punished by imprisonment<br />

<strong>of</strong> up to three (3) years.<br />

6. When the <strong>of</strong>fense provided for in paragraph 1 or 2 <strong>of</strong> this Article results in the death <strong>of</strong><br />

one or more persons, the perpetrator shall be punished by imprisonment <strong>of</strong> one (1) to<br />

twelve (12) years.<br />
