the verification period but it is established by a final judgment only after the expiry <strong>of</strong> the<br />
verification period, the suspended sentence may be revoked no later than one (1) year<br />
after the expiry <strong>of</strong> the verification period.<br />
2. If a convicted person fails to comply with a condition imposed by the court as provided<br />
for in paragraph 3 <strong>of</strong> Article 51 and 59 <strong>of</strong> this <strong>Code</strong> within the time determined by the<br />
court, the court may revoke the suspended sentence no later than one (1) year after the<br />
expiry <strong>of</strong> the performance <strong>of</strong> obligations.<br />
Article 57<br />
Suspended sentence with order for mandatory rehabilitation treatment<br />
1. The court may impose a suspended sentence with an order for mandatory rehabilitation<br />
treatment, where the convicted person is a first time <strong>of</strong>fender and a drug addict or<br />
alcoholic if the court, after reviewing the report <strong>of</strong> the probation service, determines that<br />
the primary factor motivating the criminal <strong>of</strong>fense was related to his or her drug or<br />
alcohol addiction and that successful treatment would minimize the risk <strong>of</strong> the<br />
commission <strong>of</strong> another criminal <strong>of</strong>fense. The court shall state the period during which<br />
the mandatory treatment program should commence and when it should be completed.<br />
The period <strong>of</strong> mandatory treatment shall not be less than three (3) months and shall not<br />
exceed twelve (12) months.<br />
2. The probation service shall supervise the rehabilitation treatment program.<br />
3. The punishment will be deemed as served upon completion <strong>of</strong> the rehabilitation<br />
treatment program as required by the Probation Service.<br />
4. If the convicted person withdraws from the rehabilitation treatment program, does not<br />
maintain contact with the Probation Service or does not perform obligations related to the<br />
order for treatment, the court may replace the previous obligation with a different one,<br />
extend the duration <strong>of</strong> the order for treatment or revoke the suspended sentence and order<br />
the execution <strong>of</strong> the punishment provided for in the suspended sentence.<br />
Article 58<br />
Suspended sentence with order for supervision by the probation service<br />
1. The court may impose a suspended sentence with an order for supervision by the<br />
probation service if the court determines that the integration <strong>of</strong> the convicted person into<br />
society or compliance with any conditions imposed by the court will be better achieved<br />
through supervision by the probation service.<br />
2. When imposing a suspended sentence with an order for supervision by the probation<br />
service, the court shall order the convicted person to maintain contact with the probation<br />
service. The court may also impose one or more <strong>of</strong> the conditions set out in paragraph 3<br />
